Barack Obama is the President, so he should nominate an appointee in a normal amount of time. The Senate then has the responsibility of approving. That's the part that will probably take a while, and that's not a problem.

"Let the people have a say," Constitutionally, is a dumb thing to say.

Specifically, they didn't want a recess appointment.

At least, that's what the resolution said. Of course, it was just a non-binding expression of their opinion, not any sort of law passed.

This wouldn't be an issue today. Obama will not make a recess appointment.

But hey...I actually don't agree with delaying for 10 months if Obama nominates someone worthy of confirmation.

I was responding to the line of thinking that Obama was duly elected...he was...and so were all the members of the GOP controlled Senate.
