Why is prostitution illegal?

I know it's legal in parts of Nevada, but is there a rational reason for this to be illegal everywhere else?

Same reason crack cocaine is illegal. Sure, it's a personal choice one makes about their own body/behavior, but it has a negative enough effect on the surrounding environment to disallow it.

Well, I have an opinion about why it’s bad, but I can’t speak for the people who made it illegal.

Any sex outside of marriage is bad for families, and therefore bad for society. That’s probably not why it’s illegal, though.

Why is it bad? Think of the women you love; your wife, daughter, nieces. Ask yourself if you'd be okay with them selling their bodies to men. If the answer is "no," think about the reasons your answer is "no." Those same reasons apply to everyone else.

Forget about anything society thinks about it. Go back to my question and ask it for yourself - independent of what society thinks. Would you be okay with your daughter earning money that way? If not, why? And if its not okay for your daughter, why is it okay for someone else's?

It's ultimately her right (or my son's right) and like many things they do that I probably wouldn't agree with, I would support them and love them. But, I would worry for them because of the consequences that come with it, but if those consequences were mitigated or changed then I'm left with my original position.

Well, if the consequences for robbing a bank were changed more people might do it. I'm trying to understand your point. Seems like you're saying, "If prostitution wasn't bad, I'd be okay with my daughter being a prostitute." But the consequnces are bad, which is why society doesn't look favorably on it.

If so, then I'd like to see you attempt to make that comparison.

In regards to my point, I'm saying that making prostitution illegal comes with negative consequences that, in my opinion, are worse than the consequences a person would face if prostitution/sex work was made legal. Making it legal opens it up to regulations that would protect the workers and as cac2011 pointed out it would also help fight against human trafficking (not to mention, it can then be taxed). The only downside I can see would be from society "looking down" on the workers and from a religious standpoint. When I weigh those arguments, it seems to be a simple conclusion.

As for my bank robbery point, if you're going to suggest that if changing the consequences for something changes how we think about it, then it's reasonable to think that if we stopped punishing bank robbery, we wouldn't view it as a negative.

No one really belives the only consequences to prostition are legal. If you removed all legal ramifications for prostitution, would you then be okay with your daughter becoming a prostitute? No, you would not. And the reasons you would not are because there are consequences which go beyond the potential for being arrested. In short, your daughter selling her body to men would not in any way be good for her. Since it wouldn't be good for your daughter, I propose it wouldn't be good for anyone's daughter.

If you disagree and think that if we'd remove the negative consequences for prostitution, our society would think differently about it, then please explain how that would make you okay with your daughter doing it.

There are plenty of things you might not want your daughter doing that aren’t illegal. Most parents wouldn’t be thrilled with their child being a stripper or a pornstar but those are still legal.

Setting up our legal system based on what we’re okay with our kids doing seems like a pretty poor way to organize society.

Laws aren't established based on what you don't want your kids doing. I think they are statements on what we feel is best for society. As a society, we think it best uou dont drive while intoxicated, take what isn't yours, and that women (or men) sjoild not sell their bodies for sex. You can think otherwise but it still begs the question, if you do think otherwise, why would you not be okay with your son or daughter doing it.

fits better with the war on drugs. Bank robbing has no argument about whether or not making it "legal" and with regulations would change the harm it does to society. It's more similar to "absolute harm" like murder. The war on drugs, instead, is more complicated and with that, it has a component where you can look at it and say, "maybe penial punishment doesn't work in all cases and maybe makes matters worse." That same argument can be applied to prostitution and has been made quite often. If you can find anyone arguing the same about robbing a bank, please point me to it. I'd actually like to hear that argument being made.

My argument (or really, more a question, because I'm not necessarily a proponent or opponent of making prostitution legal, but I do think there is an argument that can be made that isn't being considered here) is what are the negative consequences to legalizing prostitution versus the negative consequences to keeping it illegal?

You make a fair point about the bank robbery analogy.

The most obvious benefit to legalizing prostitution is no arrests for soliciting prostitutes, prostitution, or pandering. I guess you could organize it in a way which allowed for collecting taxes. I think there is more at stake than arrests and taxes. Does anyone really belive a woman winds up a prostitute by choice? Do we really want to be okay, as a society, with women who have sufferred addiction, povery, and past abuse sellling themselves in this way? I understand it's the world's "oldest" profession and isn't going away. I also don't believe that means we have to shrug our shoulder's and be okay with it.

If a person thinks it's okay and should be legalized, nothing I think or say will change that. My question has been and remains though, if you think it's good enough for someone else's daughter, please explain why is isn't good enough for yours?

because of how it's treated in society. It's a "sin" and so it's treated as sinful and "wrong" and people don't want their children ever doing anything "wrong." But, if society changed how it viewed it and treated it differently, would a parent feel differently? I don't know. But I think it's a deeper question and not at all an absolute.

You may be correct but I have a very hard time believing that the vast majority of people would be okay with their daughters doing it - regardless of how society viewed it. Still, no one has yet tackled the question head on - would you be okay with your daughter doing it?

For them, the debate against has been because it leads to sex trafficking. The Red Light district is a site to behold in Amsterdam for sure, and it is highly regulated. According to a Dutchman I was speaking with, even though it is regulated, there are still women in the business that are doing it against their will.

what happens. Of course morally there’s no defense of prostitution. But if you legalize it you can control the spread of sexual disease, stop sex trade trafficking, and collect tax revenue. And the women that are prostitutes will be obviously safer and at least feel as if they are more legitimate.

Another factor that almost none of us can relate to is that they are some men that because of various limitations don’t have women willing to sleep with them for free. What about an autistic man? Is he supposed to never have sex in his life because he has a disability?

In many ways I think it makes life simpler if sex is transactional. No strings attached. The woman gives sex and she gets money and then it is over. The man understands the nature of the transaction and both leave satisfied. Many relationships between men and women are indirectly prostitution anyway. Its indisputable that so many men shower women with gifts and money to convince them to sleep with them, and how many women agree to sleep with a just because he has money. You can make the argument that prostitution is at least more honest and straightforward than rich men using their money to bribe women to get sex legally.

Just offering food for thought. I get the arguments against prostitution completely. I have mixed emotions. But just offering something to think about.

Yes I agree with you on that. Marriage and fidelity make our society much better. It’s like the speed limit. We collectively have to compromise for the good of society.

But what about the freaks and disabled of our society that for reasons that aren’t their fault aren’t capable of raising a family or marrying a women. Is it OK for us as a society to say sorry you have to be a virgin for the rest of your life?

I'll answer that for you, it is not enforced. 45 is a known adulterer, with a pron star no less, yet I don't see any conservative Christians clamoring for him to be prosecuted. Of course that's all part of the MUST PROTECT DADDY routine. That there shows that people, (Christians as well), don't give 2 chits about the sanctity of marriage.

So again, why is prostitution a crime that is enforced? The police are so concerned about this that they routinely set up sting operations.
