Which also means that they are not subject to any rules in place by the NCAA. Either you are part of and play by all the rules or you don't there is no middle ground. This could be the last nail in the NCAA's coffin if they don't fight this and win!

Laws that prevent the NCAA from illegal restraint of trade don't invalidate NCAA rules about anything else.
This is absokutely not an "All or Nothing" situation.

Where that argument loses it punch is that these are supposed student-athletes, who are considered amateurs. As soon as it is considered payment for playing then at that point they are professionals and don't fall under the NCAA. The Universities have to either accept them all as employees and all that it entails or they have to disassociate themselves from that endeavor. This is not gonna end well for the schools and so many young people are gonna lose a chance at a free education. It might not be this year or next but that is the path this is headed.

When they become "employees" look for the love and nurturing coaches to fall by the wayside. Georgia is a right to work state meaning the employer doesn't have to give notice or reason for firing. Theoretically, UGA can enjoy the by week at the start of the 12 team playoff, watch a Michigan or Ole Miss lose, drop their ILB or OT and pick up an athlete that would be heading to the couch for the rest of the playoffs. The cut player would have no claim to scholarships or any other benefits from the school. Somebody....NCAA, Conferences, Schools or players union (it's coming) is going to have to step in and lay down some law and order or risk losing the 81M fans of conferences outside the B1G and SEC.

You never said the stated workers were employees of the Universities, only students. When they become employees they are not students, and have to follow the guidelines of Employer/Employee Laws. At that point what we have come to love as "College Football" will cease to exist and is a second level professional league, that opens another set of problems that those Universities are not capable of managing!

It's completely bogus.
Students can be university employees and it happens all the time.
Graduate assistants. University employees working on a degree. Clemson cops and firefighters taking classwork.
Moreover, the athletes may be contractors, not employees. That moors every one of your speculation items.
College football is going to be fine.

Ohio and 16 other states about transfer restrictions.
Tennessee and Virginia about NIL.

Revenue sharing means they are employees not students. So if they bring embarrassment to the University they can be fired on the spot! Oh that vulgar action is cause for termination, that targeting is assault, your terminated! As far fetched as that sounds, really can we not see that actually happening? There is no common sense to balance the scales. No one can legislate common sense. If it were possible we wouldn't be 37 trillion dollars in debt, having to vote for the lesser of two evils in almost all elections, local, statewide and national.
