NIL is beating a dead horse but here goes!

Should there be some requirement that those receiving NIL money do something to justify their receiving it other than playing college football? Otherwise it is just payola and another way to skirt paying athletes on a scale determined by their value to the football team. I think I read that the Dallas Cowboys were nailed (or prevented) for skirting the NFL cap structure by some bogus way to pay specific players more money that would have broken the cap.

I am not anti NIL, but think those receiving should do something to justify their pay ..... other than showing up at a car dealership for a couple of hours and receiving a million bucks.

I’m not sure there is anything that can be don on that.

NIL can never be regulated or capped. It’s a free market where these kids are able to accept any amount of money that a person or company is willing to give them. Trying to cap it would be like telling LeBron he can only accept $1 million from Nike or Gatorade for endorsements. Never going to happen. The ones paying for the endorsement are entitled to pay as much as they can afford to pay and the kids are entitled to make as much as they can based on owning their name, image and likeness.

I think you are right ...... and that is probably the way it should be. But at some point, those individuals or companies furnishing the money will either hope for a return on their "investment" or just have so much money, like Phil Knight, that it does nor matter. I guess killing the goose that paid the golden egg is a possibility.

In a day of social media and influencers, they honestly could just ask the kid to make a post on his twitter or IG and that would be worth it to them.

They are currently looking at ensuring that what the student is getting is indeed fair market value for what the student is providing. In theory this would bring NIL payouts in line and reduce the likelihood of pay-for-play which is essentially what we are seeing now.

Now does that make it through all the hurdles? Maybe, maybe not. I am guessing in some form it will, that still needs to be determined. Lots of devils in the details

Even after that the real issues begin. How do you independently quantify the value of marketing that a QB provided to a major software company is in fact ~$10M over 3 years?... without asking the company itself? You would need a branch of the NCAA and/or IRS to do that.

It will be interesting to watch.

It is very unlikely to survive legal scrutiny for several reasons.

1. The 9-0 SCOTUS decision against the NCAA.

2. The injunction in the Tennessee vs NCAA case that says that the NCAA cannot interfere in private NIL.

3. The Sherman Antitrust Act that prevents a third party from interfering in a business relationship between two other parties that begins or maintains an illegal monopoly.

4. The athletes that are not involved in the House case. Some of them are challenging the NIL clause.

The bottom line is that the NCAA is acting like they have an antitrust exemption for this. They don't, and it wouldn't matter to NIL if they did.

While it is certainly possible the settlement gets approved with no NIL guidelines it is certainly not a foregone conclusion.

Judge Wilken originally rejected the settlement over language concerns around pay-for-play and restrictions around NIL agreements. However once amended she gave preliminary approval which is a very good indicator that it will be approved next spring. Federal judges don’t like to have their decisions overturned so I am thinking she feels pretty confident it won’t be.

What I personally think is that there will be some NIL guidelines and rules in place. I don’t pretend to know yet what those will be or what kind of teeth they will have but if it’s in the settlement it will become the new landscape… until it’s not.

I’d be willing to be most major D1 coaches and ADs know what the guidelines could be and are already planning ahead with them in mind

There will be challenges for sure, wacky Cali is already saying the settlement would force them to break the state laws they just passed. Not sure that will fly

What happens if the top schools break away and form a private club for football? Are there ways to get around court rulings with a private club designation?

No any rule a private club came up with that is counter to federal law would be unenforceable.

In reality that’s what the NCAA is anyway. It’s a member institution that schools choose to belong to and agree to live with the bylaws.
