working towards forming a new entity that will police the new salary cap (revenue sharing) and NIL payments, as well as administering penalties related to those areas and tampering. There has been a committee of Power 4 Conference Athletic Directors working on this and Graham Neff was named in the article as one of the ADs on that committee. Sounds like they plan on the NCAA only handling things like eligibility of players. See below.

How are they going to enforce it? Who writes the rules? Who investigates? Who makes the ruling? Who handles appeals? Who enforces the ruling? Sounds a bit like asking foxes to guard the chicken house.

I'm no attorney. But, here are some immediate questions I think of.
1. How can any governing body tell State Farm how much they can pay Cade Klubnick to be their college version of Patrick Mahomes?
2. How can any governing body tell a private institution (Miami, USC, Notre Dame, etc.) how much they can pay a starting QB?
3. For that matter, how can any governing body tell Clemson or Georgia or Michigan how much they can pay their starting left tackle? If the state says it is legal, how can any governing body say it isn't allowed?
I see no way to control how much outside (truly outside) income a player can make that courts would allow. (Essentially it would be wage and price controls.)
I see no way to control how much universities play players without the players being employees and salary structures be agreed to through collective bargaining.

Actual NIL isn’t at question. Regulating pay for play is.
Companies know and can calculate how much a celebrity advertisement is worth.
Companies especially those operating in the grey do not want anyone asking difficult questions.
There will be lawsuits, at least the ncaa will be driving action instead of waiting to be told.

The NCAA (or whatever it is called) can tell Arch Manning that he can only make 2 million dollars from State Farm Insurance?
I can see how the NCAA (or whomever) can tell Clemson how much they can pay Cade. But, how can they tell State Farm, "Sorry, you can't pay Arch Manning 5 million dollars for appearing in a commercial with Mahomes and Kelce?
I can't see a world where the NCAA (or whomever), "Texas, Arch Manning made more than he should have made from State Farm, so you are penalized 5 scholarships next year."

Market value is easily determined. There are multiple comparable factors. (I’ll keep this basic and use easy made up numbers for clarity) If State Farm (per your example) is paying a local celebrity (say a popular weatherman) $5000.00 for a commercial and is paying “Jake” 1 million a year to be their national spokesman, then a payment of 5 million a year to Arch Manning (or Cade Klubnik) is obviously a pay to play scheme and not a fair market value NIL deal.
