If the state law says they can, then why would a court rule against it? Why would Constitutional "originalists" overturn such laws?

Personally, I think the best way, if it can be enforced well, is that ballots have to be postmarked on Election Day. That just makes the most sense to me. I wouldn't make people who want to vote by mail vote earlier than everyone else.

I agree with that and so do most states. How Pennsylvania handles it's voting is not a constitutionally reviewable case. It's none of SCOTUS's business. That's why they refused to hear the Pennsylvania case brought by Republicans.

States' rights are constitutionally enshrined. Barret isn't going to help anyone.

and its been the law since 1845. prior to that, there was chaos as to when the election was held.

When is a vote held? when it is mailed? when it is bubbled in? when it is post marked? when it is received? when it is counted? I suspect we'll find out what Justice Barrett thinks soon enough

or at least accelerated by, the development of mass communication technology that could let people far away know what is happening.

I know it's a matter of opinion, but as long as the votes have to be cast, (decided, not able to be changed) prior to results being known, that seems fair, even if the cast votes are not in the hands of vote counters immediately.

I predict that Trump and the GOP will do everything they can to throw out votes.

If an eligle voter, complied with the rules, they're vote should count.

Virtually every attempt by the GOP asking courts to throw out ballots had been thrown out by the courts.

If you don't think that the dem. will wait and see what the totals are today and tomorrow and try to get more votes in so Biden can win then you are not paying attention. Biden and his people are say there is no way trump can be call the winner tonight or tomorrow. What is up with that, my guess is they will try to get enough votes after today to win. That is just a guess.

Trump can't just declare himself the winner before absentee ballots are counted. That is the topic of discussion. Absentee and mail-in ballots get counted last in many states. This happens every year.

Stop with the conspiracies.
