Just a guess, but seeing the disorderly conduct,

Nov 15, 2012, 1:08 PM

I'm guessing the guy's mouth made a bad situation worse, so the cops decided to show him just how serious it could be. Not making a moral judgment on the guy or the cops, just guessing about the situation....

Must have injured or fought with the arresting officer. Just my guess.

Whoever he took the money from must have complained.

At that point, I guess it's the equivalent of walking into someone's house and taking money. Felony.

Sounds like he was running his mouth as well. So they hit him with what the letter of the law says....

Burglary 1st degree

Nov 15, 2012, 1:53 PM

it is the entering into another persons house or dwelling with the intent to commit a crime therein with the additional of an elevating factor, such as it occurring at night time, a weapon being involved either in the commission or the flight, an injury to someone who is not a co-defendant either in the commission or the flight...

The intent to commit a crime therein is the taking of the money. the intent can be formed while in the residence.

Burg. 1st is a most serious offense, carries anywhere from 15 years to life.

This fact pattern is ripe to be plead down to a lesser included.

Nothing like the prison industry... (15 years to life)?***
