Murder 2, Biden is praying for that.

We will see just how much clout he has with the big guy.

I think for a couple of grand, a guard would be willing to set up a conjugal visit with one the boys from A block. I'll start a go fund me.

Can't predict the jury. But when looking at what the

prosecution had to demonstrate, it seems to me to be an acquittal or a much lesser charge.

We all know that a criminal trial is not a debate about what we think happened. It's about 'beyond a reasonable doubt'. It seemed to me that the state had to show (1) the knee was on the back of the neck, (2) that that action caused death and (3) it was an unreasonable action in that time and place. To me, they maybe showed #3, maybe not. But #'s 1 and 2 were way too iffy to reach "beyond a reasonable doubt". A civll case might go against him, but I don't think a criminal case was made. We'll see.

Certainly there were no solitary holdouts on the acquittal side, no arguments about that.. It was all in, all 12, either way, which in this case sounds like guilty. And the judge has basically said Waters gave the defense grounds for appeal. This could be interesting.

Guilty, but he'll appeal it. Meanwhile, he'll be in prison.

Apr 20, 2021, 3:56 PM

Considering the video, no way he's acquitted... Not a frickin' chance.

2024 white level memberbadge-donor-10yr.jpg flag link military_tech thumb_downthumb_up

If by 'video' you mean the looks of the most famous one

Apr 20, 2021, 4:03 PM

you are probably right. Taking all the videos, the defense convinced me that the knee was certainly on his back for much of the time, maybe all the time. The prosecution had docs who said that if the knee was on the neck he could be choked, but the coroner, the official doc, said probably not. If you ask me to convict a guy for murder with that much pro/con on the evidence - given the deceased health and fentanyl - I couldn't do it. But you might be right that the violent look of the famous video is enough, given the surrounding emotions of this case.

There was something said yesterday by the defense

That planted a seed of doubt in my mind

I can’t remember now what it was, but as I talked to a friend right after we agreed it would be impossible to tune out what you already knew

Waters didn’t help anything with that comment

Agree it could be very interesting from here

flag link military_tech thumb_downthumb_up

Right. What I thought I knew going into the trial was

Apr 20, 2021, 4:22 PM

the video we had all seen, and all the conclusions drawn by so many. Then the defense began to question each of the assumptions proposed by the video, and danged if they weren't, to me, right. But yes, it was at first hard to think the defense wasn't just spitballing, because I thought I knew what I already knew. But I think they're right. And by 'right' I don't mean innocent - he may or may not be - but not guilty.

Falsehood flies, and truth comes limping after it, so that when men come to be undeceived, it is too late; the jest is over, and the tale hath had its effect: like a man, who hath thought of a good repartee when the discourse is changed, or the company parted; or like a physician, who hath found out an infallible medicine, after the patient is dead.

Defense should shoot for a mistrial based on public statements of politicians swaying the jury (who were told not to watch the news, but still...).
