You can't make this stuff up.

What a legal defense.

I didn't read the article, but from that it sounds like it worked, although we all know that too many viewers take him seriously. I guess the key word is "reasonable" though.

Don't get me wrong. The same defense could be used against

Oct 29, 2021, 4:48 PM

Al Sharpton or Rachel Maddow, or anyone else I guess.

But it just shows how far the "news" has declined. I feel bad for old people who watch that crap for hours every day.

Tucker is more extreme than them and that's saying something. Tucker is starting to get to Marjorie Taylor Green type stuff. He is calling January 6th a false flag now. He is starting to lose his mind. He was once somewhat normal 15 years ago.

flag link military_tech thumb_downthumb_up

and that articles headline is very misleading

Oct 29, 2021, 4:59 PM [ in reply to Don't get me wrong. The same defense could be used against ]

they put in quotes " reasonable viewer" "persuasively", but no where in the article are the words takes Tucker Carlson seriously.

so they can make direct quotes for a few words, but can't post exactly what was said?

This seems more like, what they are accusing Tucker of.

Any this is by no means trying to say Tucker is great, cause i hate his show.

You people must drink too much and have no memory. We've covered this numerous times in the past.

The headline is total BS. Read the case and you will figure out the context of what Fox said and why. Totally makes sense.

As Defendant notes, Mr. Carlson himself aims to “challenge[] political correctness and media bias.” Def. Br. at 14. This “general tenor” of the show should then inform a viewer that he is not “stating actual facts” about the topics he discusses and is instead engaging in Case 1:19-cv-11161-MKV Document 39 Filed 09/24/20 Page 11 of 19
12 “exaggeration” and “non-literal commentary.” Milkovich, 497 U.S. at 20-21; Levinsky’s, Inc. v. Wal-Mart Stores, Inc., 127 F.3d 122, 128 (1st Cir. 1997)). Fox persuasively argues, see Def Br. at 13-15, that given Mr. Carlson’s reputation, any reasonable viewer “arrive[s] with an appropriate amount of skepticism” about the statements he makes. 600 W. 115th Corp. v. Von Gutfeld, 80 N.Y.2d 130, 141, 603 N.E.2d 930, 936 (1992). Whether the Court frames Mr. Carlson’s statements as “exaggeration,” “non-literal commentary,” or simply bloviating for his audience, the conclusion remains the same—the statements are not actionable.

It's bullsh!t, though.

The whole point of that law was it was supposed to apply to satire, so Mad Magazine and Saturday Night Live could lampoon anybody they wanted because, well, it was satire, not to be taken seriously.

Applying this logic to the conservative media's runaway #1 infotainer - who poses as an anchor and does newsy stuff, much like his lead-in Pete Hannity and follow-up Laura Ingraham - is twisting the intent of the law into a pretzel.

In a mature civilization, lying guys who twist the public's perception of the truth like him would get chucked into the alligator pit as a warning for folks to not be complete a$$holes. And I'd stare hard at the likes of Rachel Maddow and Don Lemon too. They're not there yet but they're complete partisan shills and they peddle righteous indignation every minute they're on the air.

The difference is they don't overtly lie, though they're so partisan it almost doesn't matter. Maddow will never, ever say a decent word about a Republican, especially a Trumpist, and neither will Lemon.

The truth is rarely if ever that stark. They just omit even any mention of a viewpoint that might contradict their own; they don't twist the truth into a complete pretzel the way Carlson does, willfully. And they actually believe in their own self-righteous indignation; Carlson knows he's playing to the derps and they wanna get angry at somebody so he drags out the usual whipping boys and girls and has at it, it's Strawman Central with him, almost 24/7. You almost get the sense nowadays it's sort of Machiovellian game with Tucker now, to see how far he can move the needle, and what he can get the unwashed masses to believe.

Maddow and Lemon think they're right. They believe it too stridently, that they believe anybody who contradicts them must be evil. That's where the left goes wrong, when they believe so completely in their own self-righteousness that they make it illegal to have an opposing belief, hence the Thought Police stuff that Communist states always have, ensuring everyone has the "proper" social and political beliefs.

The far right doesn't bother with that. The far right isn't about collective belief. They're all about glorifying the individual and eff the group. The tribe just exists to give Big Boss whatever he wants...and it's almost always a "he". They believe might is right, and that the natural order is there's the rulers and the ruled. You're either a wolf or you're a sheep, and in the world of the far right, there's the Alpha Dog and the Betas, and if you're getting stepped on it's because you're a weakling and you deserve it, and if you swallow the lies they're selling you it's because you're a dimwit and you deserve to be lied to.

Tucker Carlson assuredly shares that belief. But he knows he's a ###########. He's a bright guy. He knows the difference between right and wrong. Much like Steve Bannon, he just doesn't care.

And guess what...you can hear him admit all this out loud...and your side still doesn't care. The Fascism is out and walking around in the great wide open in MAGA World now and nobody gives a sh!t.

Why are we rehashing an article

Oct 29, 2021, 11:56 PM

from an opinion site 14 months later?

Most reasonable people understand humor

Oct 30, 2021, 10:07 AM

and the use of said humor when explaining how batsh*t insane commies are (dems and most pubs)

2024 orange level memberbadge-donor-10yr.jpg flag link military_tech thumb_downthumb_up

I have said this many, many times

Oct 30, 2021, 10:12 AM

on here. I have met Tucker several times. He is a good dude and very, very self aware. He is unlike a lot of the others, he lives and breathes what he says and writes. Sure he can come across as a bit smug at times, but if that is the worst, I will take it.

2024 orange level memberbadge-donor-05yr.jpg flag link military_tech thumb_downthumb_up

He leverages argument ad absurdum quite often

Oct 30, 2021, 10:16 AM

and most people are too dense to realize it.
