“GARM is a small, not-for-profit initiative, and recent allegations that unfortunately misconstrue its purpose and activities have caused a distraction and significantly drained its resources and finances,” the group said in a statement Friday. “GARM therefore is making the difficult decision to discontinue its activities.”

Looks like they didn't have the money to fight back.

GARM may technically be set up as a non-profit, but its members are some of the largest corporations on the planet. They control 90% of global advertising spending. They're shutting down because they think there's at least a decent chance Musk will win in court, not because they can't afford to pay their lawyers to fight him. Companies are allowed to advertise or not advertise wherever they like, but it seems they might not be allowed to collude with their competitors to do so.

It kind of sounds like they were bringing a group of businesses together to conspire against another business that would have produced losses, which would most likely be illegal under numerous laws.

Antitrust laws related to illegal boycott and conspiracy.

Usually that's applied to cases where a company gains a competitve edge

Aug 9, 2024, 6:58 PM

not sure I see how that can be applied here, but let's see if Musk makes that case and how he bypasses the fact he told his advertisers to "f#ck off".

But he also filed it in a district with a very sympathetic judge, so it may make it past motions which it probably wouldn't in any other district.

You basically can't conspire a boycott to put a company out of business or to cause damage.

I'm not saying that is what's going on. I haven't seen a lot of details, but from what I have read Musk may have a legitimate complaint.

From what I've read, for the antitrust boycott law to be in play as you've stated, there needs to be a "competitive advantage" shown by the members creating the boycott, otherwise, it simply falls under a company's right to choose who they do business with. At least, that's my understanding.

It's the collusion piece that is the issue. Individually, I think you are OK if you are an individual company pulling ads, as long as you are within your contract.

competitively and commercially.

Musk telling them to "f#ck off", there not being any apparent compulsory action on the part of GARM (they provided a framework for companies to use and members were free to follow or not), Twitter/X was a voluntary member of the group, and there seemed to be no competitive advantage gained by not advertising on Twitter certainly makes it difficult to see the merit of the case, in my opinion.

Interestingly, there's a reason this is coming on the heels of the MAGA-led investigation House investigation, it's brought in the district with a sympathetic judge and GARM has now shut down b/c it's a non-profit with few resources. This is creating a chilling effect in many companies in what certainly feels like collusion by MAGA and Elon (Rumble has also now sued). Kind of ironic, really.

Why do you think Elon filed the case in Texas when none of the parties are located in Texas?
Usually, judges won't allow plaintiffs to do what Musk is doing (forum shopping) because it looks bad (impartiality is kind of important with courts).

But yeah "they" are worried more about the judge than the case, that's the point. If you had more faith in the case, you wouldn't feel the need to shop it (and I'm sure both sides do this, btw).

From Wikipedia: "In 2019, WFA formed the Global Alliance for Responsible Media (GARM), a global cross-industry alliance which aims to improve digital safety and eliminate harmful online content. GARM is made up of advertisers, agencies, media companies, platforms and industry organisations and is part of the World Economic Forum's Platform for Shaping the Future of Media, Entertainment and Culture."

From the World Economic Forum site:
The project focuses on addressing the following challenges:

Hate speech

Bullying

Disinformation

Use of personal data

Child exploitation

The goal is to accelerate and advance the role that advertisers can play in collectively pushing to improve the safety of online environments. This alliance drives uncommon collaboration to improve the safety, trustworthiness, and sustainability of media.

https://www.weforum.org/projects/global-alliance-for-responsible-media-garm/

GARM may have been a "small non-profit" but it appears they didn't lack the big horses backing their play. Speaking of their play - GARM was specifically designed to use their access to big money advertisers to censor speech that GARM (or whoever was pulling their strings) deemed "unsafe".

Seems to me GARM's whole purpose was to censor free speech based on their own criteria. I don't want Government censoring speech nor do I want some WEF friendly "non-profit" doing it either. So... good on X for going after these guys.

Meh... Don't worry - I'm sure the world's thought police will just prop up another non-profit down the road under some new name and will continue the work of GARM...

was not some little powerless non-profit getting beat up by the big bad Elon Musk and Rumble. Quite the contrary after seeing the stuff the House Judiciary was finding on them.

Looks like the head dude of GARM - Rob Rackowitz is a leftist, self-righteous choad. Dude seemed to believe that he and his organization would be the self-appointed policing arbiters of truth, misinformation, and hate speech throughout media. It's hard for me to imagine the arrogance it takes to lead that kind of organization.

Apparently GARM, through their connection(s) and close relationship with the World Federation of Advertisers, sought to inflict their media content judgements (i.e. censorship) by leveraging the WFA's ad and media monetizing dollars against media platforms. Since the WFA constitutes about 90% of all ad/monetizing dollars in media this is not some small mouse barking at a bunch of media company lions. GARM sought to get Company's like Spotify, "X", Facebook etc... to implement censoring policies that aligned with GARM's judgements or risk losing ad/monetizing dollars from members of the WFA. That's a pretty potent threat from a small non-profit...

GARM isn't the public's chosen "media police" for social media, but a group of self-appointed leftist "Karens", backed by the WEF who took it upon themselves to be the arbiters of what the public can see, read, and ultimately think. Simply put - GARM is nothing but a censorship organization who uses threat of financial loss to media Company's as a means to implement their censorship. Of course GARM wants to justify their censorship in a false altruistic cloak of stopping misinformation and hate speech but no matter how one slices it - GARM's purpose was censorship.

As I said earlier - I don't want the Government censoring free speech and I darn sure don't want a group of WEF sponsored choads using the advertising back doors of their leftist cancel culture to censor people/platforms.

I'm sure if a bunch of right wing religious types were somehow able to manipulate every major advertiser on the planet into not advertising anywhere that didn't support 100% of their views, that the leftist trash on this board (and elsewhere) would meekly accept that reality and never even consider the justice system as a recourse. We all know how reluctant leftists are to sue anyone at the drop of a hat any time they feel repressed.
