players recieve their work instructions from a state employee

how are they not employees now that they are being paid?

"College athletes who earn millions for their schools are employees, the National Labor Relations Board’s top lawyer said in guidance released Wednesday that would allow players at private universities to unionize and negotiate over their working conditions.

NLRB General Counsel Jennifer Abruzzo also threatened action against schools, conferences and the NCAA if they continue to use the term “student-athlete,” saying that it was created to disguise the employment relationship with college athletes and discourage them from pursuing their rights."

This is key.

And why the NCAA lost control. Because they were trying to limit endorsement deals as part of the "student-athlete" term. They can't do that and then use their likeness for their own profit.

The schools are not involved in NIL. Bojangles contacted DJ’s agent, not the school.

Free tuition, free room and board, better meals than the other students, sports facilities that you can do about anything yow would want, and those who help you study. Yes, I would say they are getting paid.

They better be careful with the whole “employee” thing. I don’t think most have considered the potential consequences of this. Especially since some states, like SC, are “right to work”. I don’t think they really want to be classified as employees.

IMO, if athletes start creating unions and making demands. There are very few schools that have the ability to actually pay athletes. The vast majority of schools lose money on athletics already without trying to make payroll for the athletes. And it will be ALL athletes that would have to be paid, not just the money producing ones…how much will the rowing team make? Will they form a union and walk out if they don’t get what they want?

Many schools would just give up their athletics programs.

start giving 2 week notice instead of having to wait for the a silly semester to end to switch schools. Or the Coot players all putting in for vacation the week of Thanksgiving every year.

I have a freshman son in college that received athletic $ and academic $ to play baseball (almost a full ride) For what it’s worth, he is at a great school with a really good baseball program (not Clemson, unfortunately??) and is being looked at by a few a scouts the next level.

So this begs the question… should the NCAA change the rule for my son to accept scholarship $ (athletic and academic) and reject the NIL $ to benefit the school? Or accept NIL $ in hopes of making $ to pay for COA and room/ board etc… and becoming an employee while putting the stress of performance to make $ ?

Tuition at his school is $47k… do you take that risk!? The last time I checked, Clemson is around $51k for out of state tuition….

I am going to try my hardest not to giggle when the players are forced to share their NIL money with members of the girls water polo team after repeated Title IX complaints.
