I'm not sure how any of this was 'illegal'? I can definitely see how it would be wrong in the NCAA world, but legally and at the Federal level, it just makes no sense!

18 U.S.C. 371 and 666(a)(2) - Bribery and Conspiracy to Commit Bribery. Code was convicted under 371 Conspiracy. He got caught and received 3 months. He was not alone and there are certainly others that committed the same offense but were not caught. "S" flows downhill and that is why Code and his co-worker were brought down first. They allege that Pitino, Will Wade, Bill Self, etc. had knowledge of payments to players. That makes sense to me. All 3 of them are, on their best days, unethical.

Of course I read where they highlight that most of the people facing time are black but powerful coaches who are untouched are white.

“ Eight of the nine men who were charged, found guilty and sentenced in the scandal were Black. None were in high-paying, high-profile jobs. Meanwhile, multimillionaire white head coaches like Bill Self, Pitino, Wade and Miller not only avoided being charged, they successfully avoided being called as witnesses in the two trials. ”

On the other hand, Code specifically said that the feds wanted those guys but that he would t work with them.

“[I was] the bogeyman,” Code told Dan Wetzel and me Monday on our podcast, the College Football Enquirer. “But I wasn’t the bogeyman [federal investigators] wanted. They wanted high-profile names. They wanted Sean Miller. They wanted Will Wade. They wanted Rick Pitino.”

And then later…

He wrote: “If I wanted to, if I REALLY wanted to, I could create a real s---storm in this space by mentioning the names of the coaches, athletic directors and big-time recruits at a number of high-profile universities in the ACC, the Big 12, the Pac 12, the Big Ten, the SEC and other major D-I conferences over the years whose texts, emails and phone conversations were intercepted by the FBI, who the government so deftly kept away from the jury because it exonerated us. But doing that would serve no purpose. I will simply say that a massive amount of evidence was never presented to the jury.”

Code also said that the feds wanted him to cooperate in an effort to ensnare Pitino and other big names. He and Dawkins refused to do so. “Once we weren’t willing to play their game, to wear wires and have our phone calls recorded … I think the focus [of the investigation] then shrunk.”




So, the FBI wanted to get those guys, but YOU won’t help them do it, so you’re the victim?

It is ironic that he is facing jail time for something that could easily be accomplished above board now, but I’m not interested in Merl Code’s quest to paint himself as a victim or his moral code on how what he was doing was actually right.

Pat Forde is reliable writer so this article caught my eye. Code is right. It is like the HBCU penalties from CO Infractions - flex the muscle there - but UNC has no violations?

Code is telling truth about the recruiting fallout and I don’t know whether the head coach sets it up, but go through the infraction cases last 20 years (ugh could you imagine) it will bear out.

Someone on tiger net May recall an article long time ago in SI about how head bball coaches keep clean and staff get stuck. Probably 90’s?

nearly legal now but he knew he was doing wrong at the time and has to accept the consequences for it. I do think he is the "victim" by being one of the few going to jail when there are other big time coaches, execs, involved in this that are clearly getting a pass. Phil Knight is just as guilty as Code is.

At the end of the day the entire FBI investigation didn't really accomplish much. The shoe companies still do whatever they want, those arrested and charged were assistants and replaceable employees at shoe companies/agencies, etc. And despite pretty damning evidence...they let high profile figures and coaches get away with it. Heck, in LSU's case they didn't even care that Wade did any of that.

Now with NIL..its all just a colossal waster of government time and money.
