if the NCAA had and sense they would have gotten a handle on this early and come up with a solution that would have avoided it ever becoming a legal issue. It could have gone something like this.

1) NIL would strictly be between a player and a legitimate company that wanted to pay his for "Real" services. The college would not be involved nor would the use of the college name be involved. No different than the average getting a summer job ..... between the company and the student.

2) Use of a team sport in a commercial venture, like Playstation, would involve money (royalties) paid to the university and the money divided between the university and "ALL" of the players on that particular team.

This is very simplistic and would involve a lot of details, but when the universities and supporters got involved things went downhill very fast and they have not stopped yet. To call this a disaster for college sports may be an understatement.

We seem to be making huge predictions and pointing all the blame in spite of this & the portal being basic rights issues to begin with.

There probably should have been better rules from the start of NIL, but there will be; they may have to ultimately go to the Supreme Court even, that's how essential it is in terms of rights & that's why it's lost on the NCAA---- they simply can't (& never did, & probably never should) have the power to control those rights themselves.

Eventually NIL will likely be celebrated overall, but until there are rules, we just gotta be patient & excited about what Clemson is doing with NIL & paying its players.

Not based on a person’s educational merit is when thing went off the rails because the whole thing really stopped being about education and students who happen to want also play a sport. An educational scholarship should only be based on a person’s educational bonafides.

Now if you want to hire amateur players to play a sport for your school, that should be another matter entirely. First, let’s all in the NCAA define and agree on the term “amateur”. Then pay amateurs a commiserate $ to play for your team and if they want to get an education while there, they can, but they must pay just like any other student unless they can qualify academically for an academic scholarship.

Then they can choose to play for whichever school they wish while they are still deemed to be an amateur and they can get any other job they want, in addition to playing the sport, just like any other student attending the university.

The only stipulation there would need to be is if you sign an agreement to play for that school for X years, you must abide by that contract or pay the fines/costs outlined in the contract agreement back to the school. So if you have an exit clause that says if you leave Clemson to play for another university, you owe Clemson X amount of $. How they come up with that $ to pay off their contract is up to them. In return, Clemson commits to giving them access to the university’s athletic and educational facilities, provides athletic dorm housing, athletic meal plan and perks, coaching and an opportunity to earn playing time on the team.

There can still be limitations on how many players each school can have under contract at one time.

Problem solved.

We'd have to lose MOST college sports outright under this concept (football & basketball might be able to survive in a vacuum), but it's still fascinating to think about.

Coach Swinney worked while getting his degree & winning a national title at Alabama. I don't think things were broken then even in spite of some players being paid & other rights issues like NIL & the portal not existing, but it's worth remembering for sure.

Ultimately, it started as a legal situation that the NCAA was not going to win, so they just threw up their hands and basically did nothing. When some California players, maybe basketball players (don't remember) started chirping about their image being used to make huge amounts of money for Playstation (or like video games), yet they got nothing. I think one former Clemson player joined in, among others. They had a point, and at that time if the NCAA had taken the initiative, the entire program could have been instituted that met all legal ramifications. They bailed, so here we are. None of us know how this is going to end, but it is certainly alienating many of us who have loved and supported our university athletic programs for a long time.

Caught in the middle of all of this are those student-athletes playing tennis, golf, soccer, rowing etc. that have very little chance of directly benefitting from NIL, but receiving all of the negative impact.

It seems many if not most fans associate NIL only with the most-coveted players in the highest-grossing sport, football.

However, keep in mind NIL is a tremendous opportunity for other sports outright, including women's sports in particular because of their enormous followings in spite of not having TV contracts & the same popularity.

That, to me, is a huge reason why Clemson's upcoming NIL & Branding Institute is so important & fascinating from an education opportunity on NIL itself PLUS the resources to do it.

The fact that neither the NCAA nor any organization associated with major college sports had a plan for NIL or the portal makes me angry. The handwriting had been on the wall for years and the governing bodies of college football and even the individual universities slept on it. NIL is NOT, imo, the fault of college athletes. It is the fault of every adult involved in governance in major college athletics.
My guess is that the ncaa will die and be replaced by an organization made up of (4) 16-team “super conferences” that will largely determine the playoffs and national championships.

It's not an NCAA issue, though.

If anything, their model got in the way for decades, but hear me out.

The NCAA isn't a rights organization, so to speak; NIL & the transfer portal are basic rights issues. Frankly I'm surprised this didn't go to the Supreme Court much sooner, but it does seem like an inevitability at this point (rather than something the NCAA can "solve" by fixing their previous mistakes somehow).

Everyone should simply stop using the players Name, Image and Likeness. Then everything would go back to the way it was. I'm sick of the whole thing!

If you play college sports and you make NIL money, that money should go to your education first. There should be no athletic scholarships if they are being paid through NIL deals. If they are being paid through NIL deals they should have to stay until they graduate. No more leaving early for the professional sports. As far as transferring go back to a year of ineligibility.

But that also means there can be no universal deals, like, for example, a licensed video game like the NCAA Football franchise.

It also negates any benefits outside of football; from softball to baseball to gymnastics, et al., they may make money by working for their name, image, & likeness branding they can use and develop with the education and resources Clemson is providing in the new NIL & Branding Institute, but even without the rights part of NIL, it's likely not worth it to do ANYTHING if it takes away from a scholarship.

The most popular, successful player on Clemson's title-winning soccer/softball/golf team isn't making enough to pay for their own scholarship alone every year, but everyone else would essentially be working for free IF it's money taken from their scholarship; that seems the opposite of the rights issue the NCAA had no choice but to rescind, and rightly so.
