How can anyone play this down?

Aug 1, 2021, 11:16 PM

“Boys will be boys.” Everyone was young and dumb at one point.” ????

What is known:
“The injuries the mail carrier sustained in this crash are severe and will require several months or longer for recovery,” police said it the Sunday statement.”

“Davis was unable to stop due to his speed at the time, police said. The football player is accused of driving 115 mph in a 55 mph zone.

The force of the impact caused the mail truck to flip over into oncoming traffic. Two other vehicles then collided with each other while attempting to avoid the mail truck.”

“Reckless disregard. Basically, a person acts with reckless disregard for the safety of others by knowingly doing something that poses a safety threat to other people. In other words, the person knows the conduct is dangerous but decides to do it anyway.”

The mail person may not be out of the woods with her recovery. If she succumbs to anything going forward, there can be a case, she would not have, if not for her injuries. She could still have a blood clot or something similar that is undetected.
A simple arthroscopic surgery and CJ Fuller passed (God Bless him and his family)

“Timing of the death. To be guilty of reckless vehicular homicide, the victim doesn't have to die right away. South Carolina's reckless vehicular homicide law applies if the victim dies within three years of the accident.”

Fred Davis knew wrong from right. He CHOSE to do what was not right. A person was severely injured. At a minimum they have to live with the scars and pain of his wanton disregard.

Flame away. If it happened to you or one of your loved ones, would you be saying, “Boys will be boys.” Or everyone was young and dumb at some point. Geesh… the lack of self awareness permeates.

Personally I think “boys will be boys” only covers up to 10 mph over the limit, and NEVER covers the reckless way some people cut in and out of traffic.

115 in a 55? That’s wanton endangerment of human life, and I believe Fred’s life matters, apparently more than he does.

I would agree with you. This is a young man who is in a serious situation which could be much more serious.

You're not talking about self awareness .
You have a legitimate argument made against being lenient on Davis , but self awareness isn't what the other's disagreeing with you would be lacking .

Relax
I feel for the ones who were hurt
It was an Accident same out come could have been
if the reported speed had been 50mph

Code Ann. § 56-5-2920 of the S.C. Code of Laws states that "any person who drives any vehicle in such a manner as to indicate either a willfull or wanton disregard for the safety of persons or property is guilty of reckless driving." Willfull can be defined as doing something deliberately.
Driving 25 miles per hour or more over the speed limit.
Exceeding the speed limit by 25 mph is automatically considered reckless driving in this state.
First-time violators may: Be fined up to $445.

For reckless driving, the minimum fine for this offense is $25 or $81.88 with assessment and no jail time. The maximum fine for this offense is $200 or $445 with assessment or 30 days in jail,

Reckless driving is a misdemeanor crime in South Carolina, and unlike other traffic offenses it carries a possibility of up to 30 days in jail. It will result in an automatic suspension of a commercial driver's license for a first offense, and a second or subsequent offense will suspend a regular driver's license.

The general rule in South Carolina is that traffic cases, including DUI and DUAC, cannot be expunged. There are a few exceptions, however: Reckless driving charges can now be sent to Pre-Trial Intervention (PTI) and expunged. ... Minor traffic offenses can be expunged upon completion of the Traffic Education Program (TEP)

Reported speed of 115mph very very hard to prove in a court room if it even goes to trail
That reported speed was more for a Shock Factor than a provable fact

Praying for the full recover of all the injured

I’m certain you are not serious. They can 100% tell the car was going 100+ MPH, it’s called a black box. This is nothing new, been around for years now and used in situations such as this all the time. The worst part is his disregard for others and his own safety, that’s a lack of self control.

Absolutely correct about the "black box"... No disputing it.

270' of skid marks would only add to confirm it.

Everyone deserves a shot at redemption…

Aug 2, 2021, 7:22 AM

But that usually entails a change of venue. Think Derion Kendrick. He is getting a shot at redeeming himself, just not here at Clemson.

This is the point to me, If he was not a Clemson football player it would not be all over the news. People fly by me all the time and they have to going over a 100 MPH and could have wrecked and all you would know about is there is another wreck blocking traffic. Is what he did stupid, absolutely! But most people seem to assume he does not care about the well being of the postal worker, like he is an entitled athlete. So if anyone on this board can cast a stone at some one that stone will be dust by the time it reaches its target! Because we all did stupid stuff when we were teenagers whether we got caught, caused damage to someone, or never had any consequences.

I question your self awareness. Young people do make bad decisions. Every single one of us made bad decisions back in the day. Sometimes we get by with them and sometimes not. The good thing is the law already has a penalty established for this type of behavior and I am sure the court system will dole out the prescribed justice. As for football, I am sure Dabo will also hold Davis accountable for his actions although I would point out a regular student would only face the legal system, not additional justice handed out by the head of the engineering school (as an example).

My concern with your self awareness is you seem to think this is the worst crime in the world and should be a capital offense. Note Davis's record assuming clean (both traffic wise and Dabo wise) will play a major factor in the accountability actions.

Perhaps you should stop trying to over dramatize the event and let the authorities handle the matter in a fair and impartial manner.

Amen...don't understand the hyperbolic reaction to this.

Re: How can anyone play this down?

Aug 2, 2021, 9:50 AM

There are 2 basic problems surrounding this senseless incident. First, there not enough officers in any law enforcement agency and people drive too fast on any road you wish to travel. The budget issues that restrict officers did not cause the wreck but because there is little chance of getting a ticket for speeding, more and more people do it. Second, Fred Davis is another in a long line of Clemson athletes that are wrongly put on a pedestal. Clemson athletes are young men and women that are human and I do not know a human that is perfect. Do not try to make our athletes perfect because sticking your head in the sand is not a good look.

He took a risk. Maybe he understood the risk snd maybe he didn’t. In either case, the legal system will provide punishment. He will be dealt additional punishment from Dabo that most people would never have to deal with in a similar circumstance. I took a few risks as a teen. I drove a vehicle over 100 mph and was a passenger in one traveling well over 100mph. Those times were decades ago on an essentially empty interstate but there was a risk to myself and others that I just disregarded. I was lucky. Not trying to discount what he did but many of us took similar risks in our younger days. I just pray the mail truck driver fully recovers and that she gets relief from her pain.

Scholarship athletes SHOULD be held to higher standards and I expect Dabo will do that.
