You can plead the 5th in a civil case, but the result is that your refusal to answer questions can be used against you. The other side can ask for an adverse inference, meaning that the jury is permitted to assume that your answer would have been the very thing the other side was trying to prove.
This is a stark difference from criminal court, where your right to remain silent means that your silence cannot be used against you.

That was my understanding. In a criminal case, if my understanding is correct, the burden of proof is much higher and must clear the threshold of "reasonable doubt". The guy can just sit there all day long and refuse to answer, and until the prosecution proves its case the jury's not allowed to infer a bloody thing.
Which is exactly why clamming up and saying "I ain't talkin'" in a civil case - in which the defendant isn't facing prosecution but instead the accusation that they did somebody dirty and must make them whole - isn't any sort of defense because you're basically making the accuser's case for them.
They're still doing it. Which strongly implies to my layman's mind, anyhow, they'd rather lose the case and take the hit, rather than put facts on record that can then be used against them later. In an actual criminal case.
This civil thing is kind of weaksauce, on the face of it. Which does make me wonder if Letitia is fishing for Manhattan's criminal case, or other possible criminal cases we just don't know about yet.
Do you agree, or am I missing something here?

I've got a fraud case going on right now, and the same thing is happening. The fraudsters would rather lose the case by adverse inference than turn over sold proof of their misconduct.

That's what I thought was happening. They'll take the financial hit. They can always turn around and scam it back later. What they can't afford is that felony ding because then they're DQ'd from office or the possibility of future office, which removes them as effective power players in politics. And the politics are what's feeding their present hustles. That gravy train gets cut off, Donald is staring the prospect of $1.3 billion dollars in personally guaranteed debt coming due in four years, with no further influx of free blind "investment" money coming in via sources like the appallingly named TRUTH Network. (Folks were investing, all right. In having a once-and-possible-future president owing them big markers. I don't think anyone seriously thinks Donald's ever going to launch a successful business at this point.)
And isn't Donald's new network already being investigated by the Feds? I mean, Donald can seriously bring the grift, you gotta give him that.
