Question for the lawyers out there...

Aug 13, 2020, 10:25 AM

Here's a thought: Would Justin Fields, who is by many the presumed #2 QB in next year's draft, have a cause of action against the B1G because, say, his draft stock drops as a result of not playing this season (assuming the ACC, Big 12, and SEC go forward.) Would serve them right if these athletes being denied their season file a class-action suit since the possibility of a lawsuit is what's driving these decisions anyway.

I really don't think that missing this season hurts Fields'

draft stock at all...he will be a top 3 pick even sitting out. Sure, a natty and/or a Heisman might make him a few dollars more, but what are his realistic chances of winning either of those anyway?

Now, some players may miss out on an opportunity to improve their draft stock, but who's to say? Maybe some are avoiding an injury, or a disappointing season.

I am no attorney, but I think loss of draft value would be hard to prove.

I can see both side of the situation, but as said, Fields is going to get his money if he plays this season, or if he don't. Scouts, coaches, and owners have seen enough of the kid to make their own decisions of Justin Fields!!!

Short answer NO
Anyone can file a Law-suit against anyone
at any time for any reason
Can not show a loss on a what-if
Magic word you exposed is "presumed"

Now about all the What-If
They play and he gets hurt
He gets sick and has to stop playing football
He is not able to play at a level the HC wants
HC does not have to play him
Many had Bama QB presumed the #1 NFL draft pick
we all know how that worked out. Still don't know
he will even be able to play
Who knows how many What-If would come up in a Jury Trial

Dabo 1st year at HC told one of our players who was drafted by the NFL
"the player was on scholarship presumed to be a high draft pick
but he did not have to play the player"

Playing college football is a privilege not a right
If the players do file a class action law suit which
is their right to do so
Only one who comes out a winner is the Attorney

I might be the only Juror to vote no case, dismissal, not guilty
or liable for any damages

I don't handle employment litigation but would assume you would have a hard time proving actual damages. Lost wage damages have to be proven with a certain level specificity and, as we all know, your draft status going into your final year isn't guaranteed to remain the same by the end of the season. Some judge might rule for it but I would think most wouldn't go for it. Just two my cents.

Think you answered your own question . Having cause is irrelevant. Sue first, ask questions later.
