Why should the color of someone's skin (I'm assuming that's what you mean by race) be a factor in anything? Why would someone hurt someone based on the color of their skin? Why would someone choose someone based on skin color? That makes zero sense to me.

a suggestion it should be a mandate, but one could make the case that hiring someone with an under-represented race in the industry is a quantifiable social good that, when all other factors being equal (or equal enough), would be a deciding factor between two candidates.

I mean, that is the most fair way, but I see increasing racial representation in industries, especially from underprivileged backgrounds, as a valuable social good and, in theory, a good business decision (e.g. diversity of opinion/perspective). I'd also weigh economic background as well. Giving someone a chance to break the cycle of poverty, and the ripple effect that can have, is a strong social good as well.

I always just want the best people performing. I think that is what is best for society. You live in the same area as I do, and I see lots of people from lots of different races performing at the highest level. So I don't understand bringing race into a selection process.

Those are subjective variables and opinion based. In other words, there really is not any empirical based methods to determine who "is more qualified" when it comes to judges. Since everything is quite often based on opinion, should the make up of a 9 person body be representative of the body they represent?

SCOTUS judges represent all 330 million people in this country, not just the white males. Do you not agree that since they many times have to make subjective rulings that there make up should at least look something like the demographic make up of the population?

They should represent the constitution and rule of law. They don't represent the people. At times it is their duty to make unpopular rulings, based on the law and the constitution.

Selecting people, for whatever reason, based on race is racist.

How do you measure which judges are more or less constitutional than others? It's all subjective when you get into the pool of "qualfied" judges. There is no way to measure who is more constitutional than the other. If things were not subjective, everything would be 9-0 decisions with 0 dissent.

Not saying rulings are not subjective. But they are not there to be representative of the people.

I certainly don't think the color of one's skin can determine how closely that person will follow the constitution.

As I said, when the pool of "qualified' judges is drawn up when there is SCOTUS opening, there really isn't an empirical way to determine who is "more constitutional". Therefore, I'm not sure what the issue is if you want the court to demographically look a little bit more like the make up of the population that is represented. There has never been a black female on the SCOTUS in the 200+ years of our country. Prior to KJ, there has only been 1 black judge out of 117 (0.85%). This was a good move.

That's the factor for the person getting the position because for decades and decades and decades in America, that was the reason for them NOT getting the position.

For government big positions, perhaps it's to have more of a particular demographic of the American people represented where it hasn't been before.

No it shouldn’t. The question of ethnicity should be left off of all applications and that Is Including insurance information. How do we know during an insurance application an agency intends to give someone higher or lower premiums/ rates just because of their skin color?

I have never ever ever had two applicants with all things being equal.

I also laugh when people say “underrepresented”. They say your staff should be 13% black, because that is reflective of the population; with no regard of the applicants. For instance: if blacks are 1% of applicants, why should they be 13% of your workforce in a particular industry? If I have 10 applicants and 1 is black and I hire the black guy/girl, then I have effectively hired 100% of the minorities that applied. It’s so silly.

In today’s America, if you treat everyone equally; you are racist.
