but he still did not committ assualt. What set old rudy off is that the dude told him to go f' himself, or something to that magnitude, so Giuliani lied and said he struck him, causing him to stagger, and it felt like he had been hit by a rock and was in a lot of pain, then demanded the police lock the guy up.

I think we can both conclude that, yes the guy was up to no good, but Giuliani also committed a crime when he made false statements to police. Both can be true, this is a basic principle of logic.
