Just anecdotal, relates only as to principle:

25 years ago our next door neighbor was accused by a neighborhood girl of, well, everything. The girl was about 10. Very detailed, date, time, events, etc. The story fit in with the rest of the day, places and times she and he were seen around the neighborhood, etc. This was bad.

Detectives hit his house in the wee hours, took his computers, lights flashing that woke everybody up. They then spent the day interviewing everyone, gathering the above story. It was a slam dunk.

Near the end of the day two detectives were in our house, and as much as I hated it I had to confirm some of the things they had. He was a good guy, a close friend, but some of what they had I could confirm. Our daughter had spent the day with _________ playing in the neighborhood, and was in the room with us confirming some times and places. She confirmed that they were in Mr. _________'s back yard, playing. The detectives were close to wrapping up, when at the very end they said, "And that is when Mr ___________ told you to go home, and you went home but ___________ stayed at Mr __________'s house?"
"No."

Our daughter said that Mr _________ came out onto the patio, told them they could stay 5 more minutes but then both would have to leave. She said they did, going to ___________'s house for the remainder of the afternoon. ____________'s mom than called and said she was on her way home, and our daughter immediately left and came back to our house.

Obviously that threw a wrench into everything. It took another week for the state to decide to not file any charges, and the neighborhood divided into two camps. We of course questioned our daughter and came to believe what she has said, but few others did. But a few. Most were on the older girl's side - understandably - and some of us thought her dad was going to take matters into his own hands. It never really did go away, just one of those things that simmered under the surface for years. But we all lived peaceably, and no one held it against us that we continued to be friends with Mr __________.

About 4 years later, when the older girl had started high school, my neighbor got a knock on the door. It was the kid's mother and father. She had just admitted to making up the story: she said it started as a fun thing (probably saw something on tv) and when it blew up she didn't know how to back down. As she matured and had to live with her sense of self, she could no longer live with that lie, so she told them. They manned up, walked down the street, and apologized. But they hadn't done anything wrong either. They had to believe their daughter. And we had to believe ours. No one blamed the older girl. She was 10, after all.

He could have been guilty. Or not. Either way, the state did the right thing, and he deserved to have been treated as though nothing had happened.

If anyone in the athletic department (or broader university) covered up a rape or interfered in a police investigation, they need to be fired, immediately and with cause. No exceptions.

A couple of thoughts (typed as I read the article):

1. We need to be so so careful about letting our kids on social media. This girl met him through instagram. I'm more convinced than ever that giving kids unfettered internet access is about as safe as dropping them off near Skid Row.

2. I want to know more about why no charges were brought. The allegations seem to include rape and statutory rape. Even if he says the rape was "consensual" why not bring charges on statutory?

3. The texts could be read to suggest it was an awkward sexual encounter, rather than rape. I'm not saying it was, just that the screenshot in the article aren't a slam dunk. Same thing with some of the friends' statements (that the victim said that she did not say "no.")

4. If the call records don't back up with the victim was saying, then it is more understandable that no rape charges were brought (still not sure why it isn't statutory rape)

5. It looks like CUAD followed policy since no charges were brought.

6. Where the hell was the Clemson media on all of this? Do reporters not have sources in the police department? Do they just not cover allegations like this? Strange.

Overall: It seems like a horrible situation and I feel terrible for the victim. At the very least, it seems like she was put in a bad situation and pressured into sex. It seems like charges on statutory rape were appropriate (can a SC lawyer explain why they weren't?). It looks like CUAD played it by the book but man that's tough to hear about.
