Defense lawyer is deposing my client.
We're on background.

Like most folks the lawyer's job is to go out each day and make money for -- himself. I have been in the witness chair a lot more than most, a lot more. Some of these guys are so clever it becomes entertaining.

Not sure if it's civil, worker's comp, or whatever, but the reason the defense attorney asked the question is because from his position, and that of his client, it is ESSENTIAL to know who is, or even may, be a party to the claim/lawsuit. If they end up paying a lot of money, they want to make sure it goes to the right person and that there are no additional people who may come forward at a later date also wanting money. Insurance companies HATE surprises, and HATE paying twice. Like HATE IT. They want whatever the claim/case settled and closed, and filed in a dungeon somewhere to never be seen again.
Just the other day I was talking to a wife of a guy who was deceased. She had an attorney and her attorney was sitting with her as we spoke. Going through the questions, I asked her when she was married. She couldn't recall the date, but gave a year. Same year as the accident. She then presented her marriage license. She married the guy 10 months AFTER his injury/accident. She was not his legal wife at the time. And when that was confirmed with the license, her attorney just slumped in her seat. She just saw her cut of any settlement take a massive hit, as the guy also has a minor son. She was also employed at the time of the guy's accident, making her only partially dependent over a wholly dependent son. And attorneys fail a lot of the time to even confirm their client is a legal party to the claim. This has happened many times before. I've seen cases where a woman and man were legally married, ONE DAY BEFORE one party's divorce decree was signed by the judge. Another attorney slumping in a chair. He then had to go to probate court and go through a bunch of crap to have her appointed a common law wife. And yes, even seen a couple of cases where your scenario happened. Spouse wasn't employed, but had tens of millions in assets. Husband worked, but she was the bread winner by a mile. Guy making $20 an hour and he and wife live in a $2 million home. lol. Dude probably paid the electric bill with his wages, if lucky. In that case though, it ended up not mattering.
Not a dumb question at all, for the defense attorney especially. Heck, the most interesting case was a guy who was married to a woman named Dorothy Reynolds (first wife). His last name was Rivers, so she was Dorothy R. Rivers when married to him, and noted as such in his probated will. They get divorced. Dude then marries a second time, to a Dorothy Richardson. She too becomes Dorothy R. Rivers upon the marriage. BUT, SHE never divorced her prior husband, and she and the deceased seperated a month before his death. She claimed to be his wife. Went to the probate court with her marriage license, and his will, and was named the administrator of his estate. Only problem was she was NOT the Dorothy from the will, who was in fact his first wife, and technically still legally his wife upon death. And his assets had already been distributed by the probate court to an illegitimate wife, whom they assumed was the Dorothy R. Rivers referenced in his will. LSS - Insurance carrier paid the right person and the Probate court screwed up.

It can be entertaining to be deposed. I was once asked 3 times in the span of 2 minutes if I recognized an X made on a document as my X. I had to tell the UVA law grad 3 times that no I didn't recognize the X as my X. He didn't ask me if I made the X. That answer was yes. I didn't help him out and he moved on angrily.
That WAS a dumb question.
