Confirming what was already suspected. The female victim made several poor decisions which including speeding and possible drinking and driving. In addition, she was not wearing her seat belt and had a least one passenger without a seat belt that likely led to his tragic death as he was thrown from the vehicle.
There's not much more to add. Some young friends out for a good time that turned tragic due primarily to the drivers actions. Could her family and the insurance company be sued? It's possible, but UGA has been consistent on the point that the vehicle was not for personal use which would take the insurance company out of the equation. If someone wishes to sue the deceased then I guess anything is possible with a personal injury lawyer on every street corner.

Such a ridiculous notion to even have! Everyone’s poor decisions are their own to be accountable for. She is dead and that is the end of it from anything to do with her family.

Now she was an employee of UGA and was given permission to use a UGA paid for vehicle to transport UGA players and entertain recruits. So there is a reasonable chance UGA can be held liable.

Regardless, people make poor decisions. I find it hard to blame others far from those poor decisions. UGA included. It looks bad for sure. But this litigious society has gotten ridiculous IMO. It was a tragedy. Period! Trying to squeeze $$ out of UGA because of a person or person’s bad decisions is beyond the pale. What was UGA supposed to do? Micromanage all those people the whole day? ?‍♂️ I mean seriously! ?

The "recruiting vehicles" aren't supposed to be used for 3:00 AM drinking excursions at the local strip club. UGA is fully liable and will millions on top of millions to the families, and their practice of using Toppers as a recruiting tool will come under NCAA scrutiny. Not that that matters about the spineless NCAA, but there's zero question of the university's enabling and unchecked underage clubbing in a university vehicle. You think the recruiting girls stole the vehicle, or maybe the university knows exactly what the vehicle was being used for in that tragic night?

It's illogical to say UGA has no responsibility in the matter. Watch who will have to pay the families.

So UGA AD Josh Brooks, says the vehicle was leased for "Athletic Department Business" only and was to be turned in immediately after recruiting activities.
Then how was this vehicle available for 'unauthorized personal use'?

Seems like he just admitted 'lack of institutional control' within his Athletic Department...no?

If they were told to take the car out and hit the town I can see an issue but if somebody had the keys and thought that this was a great idea then I see bad judgement on the kids part.

No Ga fan but at some point the blame needs to be directed in the right direction. With what I know which is not much I can’t see Ga saying “hey this is what I want y’all to do”. Somebody made a bad decision that cost 2 lives but just not wrapping my mind around this being on the university entirely. For all we know the lady has the keys 24/7 and broke Ga’s rules. You can’t supervise college kids 24/7.

There was either institutional control of university transportation or there wasn't.

I used to run the financial analysis for our company's T&E and saw far worse instances of employees misusing company resources. This is simply a job performance issue.

First off - the two women were not "College Kids", they were 24 and 26 year old employees of the University of GA and, IF, they went off the reservation, on their own, with no implied consent of the athletic department in regards to fraternizing with "College kids" under their direction, then a natural question might be why they did this? Could it have been just "college kid" stupidity and lack of awareness or could it have been that such actions were common at UGA and perhaps even expected. We are not talking about a run of the mill night club with music and dancing, we are talking about a strip joint which in and of itself brings into question the treatment of women as sex objects.

Again, these are not college kids but professional employees who we assume have undergone extensive training in regards to their protocol with the students under their charge. I say assume because of that's the not the case, that's another conversation.

My assumption, from various sources, is that this wasnt the first time that this type of activity has occurred within the UGA athletic dept but I might be the last time if smarter folks prevail.

Also, there is some thought that there was another car load of UGA football players involved and there MIGHT have been "racing and chasing" involved, thus the high speed and total lost of control, that plus alcohol or weed. This is the "other shoe" that may or may not drop depending on how far the AJC wants to dig.

Lastly, just IMAGINE what the reaction would be IF the driver was a UGA football player and the dead included a female staffer.

Now, there will be payoffs and settlements but the amounts offered will dictate how far this goes.

Always follow the $$$$$ and quality culture and UGA football will NEVER be spoken in the same breath. LOL

I think you also have to ask what if this were two male employees of UGA that took two underage females who were on the gymnastic team to a strip joint or bar. I guarantee you the **** would hit the fan. I feel quite sure that UGA has been in deep talks with their attorneys as to ho9w to and what to admit to regarding use of the vehicle. I will bet anything, that use of these vehicles for personal use is very common.

It is indeed a shame that the deaths of two fine young people will get lost in all that surrounds this.

The AD referred to the car as a rental and according to the police report: “The police report listed the owner of the 2021 Ford Explorer as EAN Holdings, which is the official name for the rental vehicle company that does business as Enterprise.”
From these pieces of info I surmised that this vehicle was a short term rental, probably only for the weekend, that she rented on a university issued corporate credit card. Do you have some other information with which to educate me? TIA.

I say that the university had knowledge of these “unofficial trips” and that there was a pattern of poor behavior, and that this was an unfortunate accident waiting to happen.

The use and control of University resources is on UGA and the Athletic Dept. to wit the vehicles were assigned.
Proper tracking and record keeping as well as safeguards to prevent misuse is part of institutional control.
It should be easy to find out if there was any monitoring of this fleet and who was responsible for securing the vehicles and possession of keys.

Tragic deaths occurred because there was either a faulty system, no system, or negligence in AD protocols.

This has to be very closely analyzed to prevent any future instances of this type.

There is no evidence to suggest that this particular vehicle had anything at all to do with the accident. Your logic supposes that these 4 people could not have gained use of any other vehicle and that they wouldn’t have carried on with their night in exactly the same manner; just in a different car.

As far as control; none of us have any idea about how these vehicles are managed or if this is the first time or 50th time they’ve used a recruiting vehicle for personal use. But even if it wasn’t the first time, what of it? She was a licensed driver that presumably met all of the requirements to use the vehicle as part of her normal work duties. That she was using the vehicle outside of job duties is a financial control issue not a criminal one. You’d have to prove that the university knew that she was planning to use the vehicle in an unsafe manner and did nothing to prevent it. For example if instead of a night of drinking she had used it to drive these players to the airport and had an accident would the school be liable? To be held liable it’s gonna have to be proven that they allowed someone to use the vehicle who they knew was unfit to operate it safely.

It’s an enforcement issue

If your company enforced the policy and disciplined the violators, then they had a leg to stand on.

If they didn’t enforce the policy, then they would be negligent at best and complicit at worst and exposed to liability either way

And you know darn well what UGA expects these staffers to do when recruits are on campus. All business is “official business”

The employee used the company car on a personal matter. That was wrong. A tragedy occurred - it would have been a tragedy if it occurred in her personal car.

I'm sure there will be an internal investigation as to whether employees are encouraged to use company cars on non-recruiting trips with athletes. Is there an unwritten rule that contradicts the written one? I'm sure that will all come out, because it is a matter of the State.

I'm sure UGA will get sued by somebody, because they have the deep pockets.

But to pretend that, on the surface, this offers any hint of lack of institutional control... talk about jealous Tiger fans. Let's not embarrass ourselves.

As someone mentioned elsewhere, if you have dealt with employees with expense accounts, use of the company car is about as small potatoes as it gets. BUT, as someone who directed a sales force that had company cars, we had a strict (to the point of being unrealistic) no drinking on the road policy, no expensing a beer with your dinner, no carrying booze in your car, because, god forbid, something like this happen, we would be able to show that the employee had violated company policy.

Of vehicles racing/chasing each other. From the beginning I wondered how/why the driver couldn’t hold the vehicle in the road if another vehicle wasn’t involved. These kind of 1 vehicle wrecks are baffling to me. From the video I’ve seen showing the people leaving together there were multiple players walking out with the staffers. They had to be in several vehicles.
It’s a miracle I never got pulled over for DUI when I was under 25 years old so I can’t be judging anyone but I have to say that back in those days (80’s) you just didn’t hear as much about safe driving like you do now. It’s just foolish to put others in jeopardy. I feel so sad for these families of the deceased. Just heartbreaking.

When the story first broke, the report indicated that several other players were following them as they were all going to the Waffle House and they came upon the accident first. This would seem to be make a "race and chase" possible and that part is being kept quiet.

Just a guess but if you live in Metro Atlanta, you will understand that these "race and chase" deals are rampant among these young people.
