NIL "Lockbox"
Feb 21, 2022, 8:01 AM
|
|
I was reading up on Dabo's latest comments about the portal/NIL money, tampering, and the general issues these things cause with devaluing education and hurting players' mental health. And I think I have a solution.
The NIL "lockbox." Basically, the NCAA establishes a trust for each player, and all NIL money goes into it and is not released until a) the player graduates, b) the player has no eligibility left, or c) the player "retires" from college football. For c) this would be an official designation and carries a two-year prohibition before returning to finish up eligibility elsewhere.
This would allow players to collect NIL money, without it become an immediate distraction to the season/team. It would also remove tampering associated with immediate gratification coming from NIL money. Also, these kids would no come into a heap of money until they were emotionally ready to deal with it, and also keep families from stealing it (we know this is a a problem...just look at Britney).
Maybe even give these players an option to invest the money into low-risk portfolios while it sits in the trust.
This, of course, would not solve everything, but I think it could make a positive difference.

The argument against this is that it is "their money" so why

should the NCAA (or schools) keep it from them. It's a good argument, but the argument that "schools are making all this money from players" also works in reverse; these players are now making good money that schools give them with the opportunity to play. This doesn't happen in a vacuum. It requires massive financial investments (and risk) into coaches, facilities, education, etc. So to some degree this isn't like they're making NIL cash all by themselves.

I am no lawyer. But, I don't think that set up is consistent with the current law. It is my understanding that the courts have ruled players can earn money for their name, image and likeness. It sounds to me like the courts would rule your solution (as good as it might be in reality) would delay that money being given to the athlete now. It would be similar to a company saying they will put your salary in a trust fund and give it to you later. While that may be legal, you would have the right to find a company that would pay you now, not later. Your system would be more akin to telling you that no matter where you work, you cannot get your salary now. You must work for free now and get paid in 4 years.

of the solution; denying access to money players are entitled to directly.
Nevertheless, if the paradigm could be restructured around this, I think it will do a world of good.

Do you have any idea how many D1 athletes there are? NIL is available for D11 and D11 as well as D1 so there is not an NCAA pot big enough to handle all of them. Just try to set up something for football and you will an army of lawyers representing athletes in the 20+ other sports out there knocking the door before the sun sets.

Hi there oh_its_JimmyHEYHEY® and bretfsu®, smart post and savy observations, respectively, from you.
Sorry to bring up old stuff, but did either of you get a chance to read the article from the Fort Worth Star Telegram (DEC_29_2021) about Texas Tech alum Cody Campbell's NIL plan?
This article summarizes Mr. Campbell's well considered (and reasonably concise) plan for colleges and the NCAA (or another authority with governing power over college athletics).
Instead of posting the link, I've post something that you can copy and paste into your browser to get to the article.

If you've already read this, then my apologies for wasting your time.

Yes, I am dating myself with that reference. However, with morbidtiger’s recent polling - there are many many on here far older than I.

1. ISSUE - Maybe the schools could have kept players happy enough to keep them from talking the schools to Court. If that ever was the case, they blew that chance. All these other options that are being thrown out , are just other forms of keeping a free citizen of the united states from accepting money for a legal skill/trade.
Your idea, would not stand up in court andly better than the dozens of others.

The one we have now seems legal. Kids can get paid, and pay taxes. We blew this one .
