MY LEGAL BATTLE IS FINALLY OVER!

It was a long hard-fought battle. I was incarcerated for nearly three years. I lost my home, my two Harley Davidson Motorcycles, my truck, my jeep, my furniture, my Kamado Joe Smoker, my Commercial Defense Contract, Clemson Season Football Tickets, and I was deprived of my ability to attend my grandmother’s funeral. She was my last living grandparent. She was my crazy Maw Maw and I loved her a lot. For 993 days, I waited patiently as my life was torn away from me piece by piece. I prayed daily, as I watched everything that I worked for being taken away from me bit by bit. Today, I am left with $19.00 to my name. An innocent man charged with a crime in which I did not commit. Several times, I went without food for weeks so that my two dogs could have food. Too embarrassed to ask others for help, I suffered with hunger pains so painful that I could not sleep. All the while, I begged for justice because I was assaulted in my home by a coward who attacked me with a blunt object from behind. While I have forgiven my assailant for his crime, I cannot forget that I was deprived of proper justice. I watched as the State shielded that man from any form of judicial punishment for his acts of cowardice. A feeling that can only be described as watching a thief wear a victim’s blood-stained coat as they testify against their victim in Court. However, the one thing that I took notice of the most was the hand of Our Heavenly Father working in all of this. I felt the prayers of those who supported me, and I felt the sting of those who abandoned me. As I type this, the only good that I can report is the righteousness of Christ. While I won the case, it does not feel as if I won anything at all. While I was blessed with God’s favor upon me today, I know that I did not deserve His grace.
It truly is heartbreaking to discover that our justice system is this severely flawed. To know that I served this great nation and even fought on its behalf only to return to a system of broken promises and empty justice, is what impacts me the most.
The experience that I have experienced I wish upon no man regardless of the allegations levied against him. It is indescribable, the feeling of knowing that what you once believed about the Greatest Nation on Earth is actually one massive lie. While I achieved a major victory in Court, I hang my head in shame for my nation. My heart will never heal from the open betrayal to an oath that I myself was bound to in my promise to protect and defend our beloved Constitution. That being said, I rejoice only in The Lord’s righteousness that was displayed upon the Record of The Court. Thank you all for prayer and support.

Maybe you should research what a Title 42 USC Section 1983 claim is before further embarrassing yourself. My criminal case is closed. I am filing CIVIL ACTIONS. I never said that criminal charges were in Federal Court. Maybe reading isn't a strong quality for you.

Why, exactly, would you file a civil suit in a federal court over local criminal charges?

1. My civil action has nothing to do with criminal charges.
2. I won in court against my criminal charges.
3. I lost my house, my vehicles, and everything else because I was forced to wear bracelets on HOME DETENTION which is incarceration because you cannot leave your home.
4. The arrest was a false arrest.
5. During the adjudication process the following Constitutional Rights were violated.
1st Amendment, 4th Amendment, 5th Amendment, 6th Amendment, 8th Amendment, and 14th Amendment.
THAT IS WHY WE ARE FILING A SECTION 1983 CLAIM IN FEDERAL COURT. If you sue the State in State court, you automatically lose. Which is why we are filing in Federal Court. Besides, Federal Court maintains ORIGINAL JURISDICTION OVER CONSTITUTIONAL VIOLATIONS. A FALSE ARREST FOLLOWED BY 3 YEARS OF WRONGFUL DETENTION AND MALCIOUS PROSECUTION IS A FEDERAL CRIME PURSUANT TO BIVENS AND MONELLE CLAUSES.

Even worse than Jail, I was forced to pay for my incarceration. The tune of $1200 a month to wear these. For nearly 3 years.

I agree, and my toe fungus is resilient. As for the green carpet, I rented a space that was in the middle of the slums. The place had black mold and smelled like old shrimp and cigarettes. I had to sell my house to afford legal cost. In fact, I liquidated all that I owned to pay legal expenses.

No, fraud is whenever you push something that's not registered and actually fake. We were registered with the Securities Exchange Commission and our representing legal counsel for doing so was Baker and Mackenzie law firm. Also, it wasn't my company. I was just campaigning for the crowd funding portion of the IPO under REG A Plus IPO regulations. For some reason, the founder of Crosswinds sold the company, and I haven't heard from him since. His name was Don Croff, but Chris Finnegan was a staff member who was allegedly stealing company funds. Not sure how true that was, but I wasn't involved in the day-to-day operations with Cross-Winds.

It was the original charge. They added BPHAN 851 Days later. They got the Indictment for DV 2nd Degree 713 Days after my arrest and incarceration.

No, I didn't beat up anyone. I was renting a room out on Air BNB and this guy refused to pay his rent. Whenever I asked him to leave, he acted like he was packing his things. Whenever I had my back turned while cooking on my smoker, he came out of his room with a blunt object and hit me from behind. It knocked me unconscious. I was listening to music on my headphones and didn't hear him coming. He beat me all over the backside of my body. Whenever, I tried to file charges or request an investigation, the Police told me that there wasn't enough evidence to prove that I was assaulted. I had grapefruit sized bruises all over my body yet, what they said wasn't enough evidence to prove an assault. The case made no sense at all and what made even worse sense was the charge in question and the 851 days it took them to obtain an indictment.

Whenever I was knocked out, the dude called the police and told them a bunch of fairy tales. Whenever I came to, I was unable to articulate my side of the story due to anger and confusion. The police believed me to be intoxicated, but I wasn't. I walked back into my house and locked the door and turned out all of the lights before losing consciousness on my couch. The Police were unable to gain entry to the home and over-reacted. 2 SWAT teams were called, but they never breached my home or made entry. I was called to the station the next morning to answer questions and they served me with an arrest warrant.

No, I never got any licks in on him. I was knocked out from behind. My behavior was raucous, and I was visibly upset on body cam, but that's about it. I didn't assault or threaten anyone. I yelled at the occupant to "get the F*** off of my property in front of the police prior to going back inside and passing out on my couch. The rest I don't remember.

No shoving or threats. I calmly asked him to pack his things and move out if he could not afford his rent. He didn't say anything which would lead me to believe that he would attack me from behind. We were friends for nearly 4 years. He was two months behind on his rent. So, to be fair, I cut him some slack. He wouldn't get a job though. He would play video games and drink all day. He had money for booze but not rent. At some point I had to address it with him. He didn't like what I had to say so he began packing his things.

The guy lied to police, and I was unable to speak on my behalf. They charged me initially with DV 2nd Degree and later added BPHAN. However, the Body Cam footage actually vindicates me and condemns the officer in question. Dude made up the entire police report to justify the warrant.

I haven't figured that out yet. I'm definitely moving to another state. I plan to recover my business in Defense Contracting, but that may take some time. Which means I have to find employment in the interim. I have plans to file Civil Actions as well, but that could take years to adjudicate in Federal Court. We shall see.

WRONG....
Nobody was drunk to my knowledge unless the other guy was. I was not placed on probation; I was placed on Bond. Probation is after trial whenever you're found guilty, but I was found not guilty and the DV charges were dismissed.
No, I'm not suing the Feds.... I'm suing the State in Fed Court.
It won't be quick, the case may take 1-3 years to adjudicate. More than likely won't be enough money to replace my home and all that I lost.
What clothing scheme are you referring to? I've never had a clothing scheme. I acted as an intermediary raising funding for a crowd funding campaign for a REG A Plus IPO offering. Other than that, I've never scammed or schemed anyone. If someone invested, it would render a Stock Warrant and all other pertinent documents required of the investment. There were internal issues within the company and the IPO was abandoned. Again, it wasn't my company, so I didn't care if they were a success or failure. At the end of the day, I made nobody any promises of any returns or any guarantees. All investments pose a risk and if anyone offers anything other than best efforts then I would run from that.

Based on the information you've given us.
You are claiming this renter assaulted you. However, your charges were 2nd degree domestic violence and breach of peace of the aggravated nature (looked it up based on the info you posted). Which means YOU were the one accused of attacking someone.
You were also on an ankle monitor, generally reserved to keep people accused of violent crimes away from victims.
How were you incarcerated for three years? Your bond was $10,000, which means you could get out with $1,000 and a bail bondsman.
That doesn't make sense you were incarcerated for that time unless you were convicted, but your post reads as if you eventually beat the charges. No?
Sorry. I've covered enough cases like this to know the story doesn't add up.

Correct, but at 851 days they changed the charge to BPHAN. Which didn't make sense at all. The DV 2nd Degree charge was Nolle Prosse after I won the BPHAN charge in Court.
April 19th, 2019, I was arrested for DV 2nd Degree and held in County for nearly a week. There was no victim..... I WAS THE VICTIM. However, due to the head injury I was unable to tell police my side of the story. They arrived at my home to an angry person who had just been assaulted and to be honest, I had such a head injury I could not recall events that took place. I was just angry. The bruises and concussion were not discovered until I was at the Detention Center.
April 24th, I was released on bond and required to pay for 2 bracelets and was not able to leave my home except to work. Finding employment was difficult during that time. Home Detention Cost in total was close to $1200 monthly.
August 20th,2021 the State brought forward a second indictment by direct presentment and added the charge of BPHAN. (BECAUSE I REFUSED TO PLEAD OUT)
Is it starting to make sense now? The case does not make sense, but I still try to tell the story as best as I can so that the overall summary makes sense.

1. Kinda sounds like you're claiming amnesia for your actions. You can't recall events that took place but now you're locked up for violent charges?
2. Why would they hold you in County for a week? You have to receive a bond hearing within 24 hours.
3. Apparently your memory over your property got jarred because you still have your home (paid taxes on it this past fiscal year), your truck (still paid taxes on it this fiscal year), and no record in Spartanburg county taxes of two Harleys or a Jeep.
4. Why in the hell would they have to put you on TWO ankle monitors? And what was the judge's reason for it? Doesn't sound like you were a flight risk. Usually that happens when there is a fear the victim could be attacked again.

1. I'm no longer locked up... I was found NOT GUILTY by a Unanimous Verdict on all charges.
2. I did suffer memory loss from a concussion, but I regained most memory recall. Still some stuff I don't recall.
3. Not sure why they held me for that long. The bond hearing was done on April 19th,2021 and I was granted bond.
4. No, I didn't pay taxes because I'm tax exempt. I no longer own the home and my 2017 F-150 and 2019 Jeep Cherokee were paid off but had to sell them due to legal fees. As well as my home. Nearly $40K in total damages for Home Detention Expenses alone. Then there were process service fees, investigation fees, and attorney fees. That was expensive. I also sold my Two Harleys that were paid off. One was a 2015 and the other was a 2017. I purchased them but never rode them much. I was deployed most of 2015-2017 on Government contracts.
5. There was no victim. The entire case made no sense. They held me for as long as they did and did what they did to force a plea bargain which I refused all 6 times. Could they have gotten a plea deal, it would have allowed them to avoid civil actions after the fact.

That's what I am wondering. 2 ankle monitors? Must have been serious. I got in a fight 4 years ago and finally went to court last year because they guy got hurt and went to the hospital(faking it imo)and I just got a misdemeanor charge and didn't have to post any bail. I never got arrested. I just got a letter in the mail saying I was charged and I got a lawyer. The guy didn't show up in court and the charges were dropped last year. Sounds like there are some details missing here and that guy must have been really hurt in Chesty's case.

The other guy didn't receive any injuries. I was attacked from behind with a blunt object and knocked unconscious. I didn't have a chance to inflict any injuries to anyone.

My neighbor is walking around with just 1 ankle monitor. He shot a dude in the face killing him and I think he also stabbed him 8 times. There was another guy he stabbed there numerous times who survived. He is walking around on bail with a single ankle monitor. That's why I jokingly asked if you were my neighbor. This guy is so confident he wears shorts everywhere. He doesn't care who sees.

1) Go find an honest job. It's a worker's market right now. Do it, do it well, and be grateful for it. Stop trying to get rich quick.
2) Stop waving your military service around like it's a fast pass at Disney World. We get it, you served, and I'd wager we are all grateful for your service....it's not the lever you think it is for instant front-of-the-line status in the real world. We have numerous lungers who served.....you have to pry it out of them to find out. They're proud of their service, but they don't wear it on their sleeve.
You're reminding me of my younger cousin who is a Marine. Once he got out, he got in with a crowd of shady people in similar circumstances, and they're always looking for some govt contract angle to get rich. He will show up in a $100k car one day and the next time you see him be explaining why the arrest charges he is facing are totally framing him.
Getting through life is pretty simple. You're not cut out to be a system-beater, so stop trying to beat it....it's the root of most of your problems it seems.

That I can only give this post one TU.
And THIS:

People who constantly throw it in your face are questionable about how honest they are about their service. Had a neighbor who did this #### and tried to give everyone the impression he was a SEAL in and the thick of some real ####. He'd constantly get smug with you that you didn't serve, and even threw it in your face when you gave him some good natured ribbing, like drinking a non-American beer. Turns out he was a CB and did some work on the bases with the SEALs.
My uncle served and as you said, he's one of those you have to pry it out of him. He's had to do some real #### and doesn't just offer that info up freely. He still works with vets and encounters people like Chesty all the time. He said it's sad and they clearly have some insecurity that makes them think the world owes em all something. Constantly. And he said they're rarely honest.

I have asked a vet if he ever saw serious combat or had to kill anyone and he told me I shouldn't ask vets those questions. Then my buddy who was friends with the dude told me later not to ask that question again or to any vet because the dude has a bunch of PTSD from Afghanistan and that you shouldn't ask those type of questions. He was one of the early dudes into Afghanistan. Looks like he could kick butt, so I just interested. Live and learn.

I appreciate the input. However, you could not be further from the truth in your assessment of me.
1. I've worked several honest jobs. Still do from time to time. I founded a defense contracting firm and I intend on sticking with that. However, I am not afraid of hard work. If you're suggesting that I've worked in dishonest professions, then I would have to correct you. Marketing and advertising are honest professions. Well, depending on what marketing material is being used. I was marketing for a legitimate IPO Crowdfunding Campaign.
2. I barely speak of my military service unless it's to honor those whom I've served with. I share my experiences from time to time with close friends and relatives. I do tell people that I served and where I have deployed, but that's about the extent of it. While I don't regret my military service, I have bigger goals set out for me in life and NONE OF IT is a path to obtain wealth quickly. It takes time, patience, and above all else.... Sacrifice to achieve what I set my mind to achieve. For the record, the Commerical Defense Contract that I was awarded in Iraq which was lost due to a false arrest was valued at $125.1M and would have grown over the course of 5 years. This would have allowed the company to hire other veterans. I'm not seeking wealth with any money; I'm seeking to achieve goals. Nothing more. I live a simple life.
3. I am not in a crowd with anyone, I am a loner for the most part and live a quiet life normally. I hate people in general and prefer to stay to myself. I wouldn't have rented rooms from my home if I didn't need the extra income at that time. Even when I rented those rooms out for the 10-month period when I did rent rooms, I usually stayed to myself and tended to mind my own business. Again, I'm not a social person at all.
4. As far as being a "system beater", I wouldn't say that I'm a system beater nor do I believe myself to be. I would rather be void absentia of any sort of system and live my life the way I want to without any disturbance. The system can mind its own business and I'll do the same.

home to 125.1M defense contract not a get rich quick plan?
I have some knowledge in the area of defense contracting/government contracts and it ain't easy, particularly for a company in an "IPO" phase. You have to be pretty well vetted before you can get anywhere near getting a contract with the DOD. And then I'm trying to figure out how the crowdfunding part works because you kinda have to be bonded for a contract of that size.

1. The IPO Campaign was not for my company. It was for Don Croff's company. I picked up that campaign gig to earn some extra money. Although it didn't pan out quite as I expected. Such is life.
2. The contract which was awarded to my company was not a DoD or DoS gig. It was a subcontract agreement with a Company in Iraq that processes Visas for Oil and Gas Company Employees. My company was to provide secure transport services to and from the Airport for the Oil and Gas Company Employees working in Southern Iraq.
3. It took me four and a half years to earn the contract bid. Nothing quick about that at all.
4. In all, I would have paid myself less than my Country Manager and Deputy Country Manager. So, nothing about that contract would have made me "rich". I would have been quite comfortable, but far from being wealthy.
5. Yes, when I worked for other companies as an employee on DoD contracts there was extreme vetting involved. Academi, Aegis, Triple Canopy, Honeywell, Trace Systems, and Sallyport Global all had me vetted prior to hiring me. Very painful process each time.
As I say, the crowdfunding and IPO had nothing to do with Defense Contracting and as far as our bonding was concerned, we had bonding that was tied in through the investor who funded our purchase of equipment and other startup expenses. USI was the insuring agency for the contract for indemnity loss, property loss, DBA injury claims, and any force majeure matters.
