This is one of the best articles i’ve read on this topic. Seems like Clemson has an uphill battle to climb if they are looking to leave the ACC.
The author said he drafts contracts such as these all the time and they are usually 20-50 pages. The ACC GoR contract is 4-5 pages, extremely broad, and doesn’t even define which state laws govern the contract.

Agree this was a good read. I think we should argue that we really aren’t getting something through this deal (i.e. no quid pro quo equals not a valid contract)

I agree though that the options don’t look great, but I just can’t imagine the same acc group until 2036 when everything is changing around us.

I think it does make sense for the majority of schools to have an issue with the revenue disparity. Main problem is that some like dear old wake forest know they will get left in dust if ACC disbands.

seem that unlikely. There’s too much smoke this time to believe that there won’t be 7-8 members ready to exit the ACC in the near future. As a matter of fact, I feel like this is going to happen sooner rather than later. These teams are missing out on too much money not to.

Absent of that, my guess is that Option 3 is already being worked on by some of the schools.

Going to be an interesting next 60 days!

ESPN played ACC, ie Swofford, like a rare violin. capitalizing on his fear of the league, and his lucrative sweet deal, falling apart they boxed him into a badly forever deal with a below market low value that degrades as time and inflation marches onward.
Where is he hiding now??

I think you figured out how we get out of it. Swofford was incompetent and unfit to enter into a legal contract. That’s our out.

The CEOs of the colleges are the ones who got duped. I can’t believe Clemson, Fl St, Miami, North Carolina would
even sign that deal.

invite to either the BIG or SEC. If we get one, I guess our best chance is to negotiate an exit fee. Until last week, I had no desire for Clemson to change leagues. I liked our path to the playoffs better in the ACC. However, as of last week, it is a real possibility that if we remain in the ACC, we will likely not have a path at all. Not being considered a school on a tier that even has a path is more disturbing that the amount of money we earn per year compared to those leagues.


Aside from concerns about the GOR, I am seriously worried that we might not get an invite at all. If the two stay at 16 for the next five years, then it is done for now.

If they go to 20, the following schools, listed in no particular order, will be considered for only four more spots:

BIG
Notre Dame
Oregon
Washington
Virginia
North Carolina
Georgia Tech
Stanford
Cal


SEC
North Carolina
Virginia
Virginia Tech
NC State
Clemson
Florida State
Miami
Oklahoma State
West Virginia
Louisville

If the two leagues go to 24 teams each, we will definitely be ok. I know we are the best brand left other than Notre Dame,and are more accomplished than Notre Dame. But there are many different reasons that could make a league choose one team over another.

Sometimes the more vague a contract is the more open to interpretation it becomes. This may not be good for us but by the same token it could be bad for the ACC. With the amount of money at stake this ain’t going to be your local ambulance chaser running TV ads handling it, some hammers will be taking closer looks and like 99% of all other lawsuits; no one truly wins but it gets settled before trial
