Good question. I’ve wondered about that. Could a player get NIL deals for “walk-ons” (technically speaking) who didn’t get a scholarship, in lieu of a scholarship? But it would be up to the walk-on to pay tuition out of their NIL deal? Seems it could be a loophole to the 85 limit? Ask Texas and A&M. Haha

In order to offer scholarships to the bottom 15% (many of whom are likely not receiving NIL), you would have to refrain from offering scholarships to your top players receiving NIL.
If I was one of those players today, I’d be receiving scholarship + NIL, so my total “compensation” package would be lower in your theoretical scenario. I don’t think your elite athletes would sign up to that option.

I think you’re missing the gist of it. You offer a 5-star recruit an “opportunity to walk on”, while he receives $100,000 a year guaranteed from a trust just for speaking at one of their engagements. He can still pursue all other NIL opportunities, and the school can allot that scholarship to someone else.

There are literally no rules anymore

You’d have trouble paying a kid to be a 6th string RB when he could play somewhere else, but nothing is stopping you. Not even sure why there would be a limit anymore. In fact, I could see an athletic department have boosters pay players as walk ons instead of donating to the school, save the 85 scholarships, and not give 85 girls scholarships due to Title 9 and use those dollars to buy even more players. There’s no rule against that.

Yes, NIL is a way to skirt the 85 scholarship limit.

There are still some differences for a walkon and scholarship player, like training table and maybe travel. Schools are forced to treat non-scholarship football players a little different. The rules are there to keep a school from easily getting around the limit. Don’t remember the particulars, but they are in the rulebook.

Baseball comes to mind in this scenario. No reason for clemson to lag behind in fan support and take away the existing advantage of some.
