York_Tiger statement Re: grounds for waiving ACC exit fee

Jun 5, 2012, 9:51 PM

Include me in the group of T-Netters who have highly enjoyed York_Tiger's sharing of Big 12 expansion plans - however he has stumbled across his information.

This statement from his last post has piqued my curiosity: "As the details of the ACC's TV deals, including Raycom, are leaked ... the ACC may not have much room for legal posturing. As a matter of fact, CU and FSU may have a case for damages (or no exit fee at the least)."

Can anyone follow up on this statement? What are these recent leaks concerning potential illegalities or neglect of duty with the Raycom contract? Are there some grounds for CU and FSU to potentially sue the ACC or avoid the exit fee? Interesting stuff. Thanks in advance for any feedback available.

I am not a lawyer, but if it is true that Swofford played favorites by demanding that Raycom get a piece of the pie, then The ACC is probably in trouble. All I know is what I have read on here, but it seems logical that Raycom's inclusion could very well be the reason we got such a rotten TV deal.

Do not know about FSU but Clemson has some high power Attorneys with a lot of pull, I'm sure they will advise and look out for what's best for Clemson

Here is the reason why...

Jun 5, 2012, 10:31 PM

1. The deal wasn't a true competition for the market value for the conference. The commissioner insisted that Raycom be apart of the deal. There is no way you are going to get top dollar when you have decided who you are going to partner with at the beginning of the negotiation. Think about anything you've ever bought of significance....like a car...you get a good deal because you have other options...you can always walk and the dealer knows this. However if you show up on the lot and pronounce...I'm going to buy a car here today and I'm not going anywhere else...you will not get a good deal in most cases.

2. Look at who operates and owns Raycom.....a NC buddy of Swofford......look at the Forbes article....Swofford has his arm around his good friend from Raycom....the guy who owns/operates Raycom

3. Look who also works at Raycom....someone's son who runs the ACC

4. Look at what the SEC did two years ago...they cut out Jefferson Pilot/Raycom...they signed a separate deal for their lower tier games with ESPN because it was a better deal for the conference/schools

5. Look at where the $ went from Raycom...it went to ESPN...it didn't benefit the conference one bit but it did benefit the commissioners friends.

This was a deal that was cut to benefit friends of the commissionor...it didn't help the conference one bit.

And that my friend is where harm/damages comes in. swofford traded something that rightfully belonged to the member schools for favors to personal friends. When he came up with such a low pay out to the member schools. How in the H&LL did he think he could keep the Raycom deal hidden. swofford belongs on the dummest crooks show.

if you want one picture to summarize why we are not happy

Jun 5, 2012, 11:10 PM

with the tv contract just look at this picture...picture of Raycom president and ACC Commissioner...chummy buddies because the Raycom guys network was just saved by the ACC. The SEC left them and they were headed toward closure so the ACC threw them a life line and screwed the conference members....made it extra big for impact....:)
