I knew this would happen once the door was cracked open with Roe...

Jun 24, 2022, 4:07 PM

Get ready to set your watches back about 100 years, folks... the Evangelicals are about to climb back into your bedroom.

Supreme Court Justice Clarence Thomas called on fellow jurists to overturn previous landmark rulings after the court nixed Roe v. Wade on Friday. The changes, aired in a concurring opinion of the decision penned by Thomas, would see limits put on gay marriage, same-sex activity, and birth control access.

"Thomas' argument was entrenched in the belief that since the Constitution’s Due Process Clause was found not to secure a right to an abortion in Friday's ruling, the court should apply that same logic to other landmark cases. He cited three in particular - including 1965's Griswold v. Connecticut, which allowed for married couples to buy and use contraception, and 2015's Obergefell v. Hodges, which allowed same-sex couples to legally marry. Perhaps most shockingly, though, the jurist suggested the court also reexamine Lawrence v. Texas, a 2003 judgement that ruled that nixed some states' century-old criminal sanctions on citizens who committed sodomy."

I wonder if he also he wants to revisit Loving v Virginia, in which the SCOTUS struck down laws banning interracial marriage in 1967. I kinda doubt it. LOL

Religious affiliation has been declining dramatically since

1999 in the US.

Look for this decision to accelerate that decline.

Anyone on the fence about affiliation who witnessed Christians overwhelming support for this have probably tapped out as well.

Technically he's correct. Those aren't constitutional rights

Jun 24, 2022, 4:21 PM

and if you don't like that, make them. There is an amendment process.

(I realize this is nonsense and the government has no moral right to regulate sexual behavior, but I'm just playing the statist game.)

Every talk show and podcast has mentioned it today too.

Thomas’s point isn’t that those things are wrong, it’s that they were never the SC’s purview, and it took a lengthy constitutional leap to make them one.

Sure they are. But this isn't about today so much as what

Jun 24, 2022, 6:33 PM

you could see coming about 100 miles away. When Scalia died in Feb 2016 and McConnell & the Pubs flatly refused to even consider filling the seat until after the election... which was almost 9 months away. And you looked at the age and health of some members of the SCOTUS... you knew, if a Pub won the oval office, he might be able to fill 2 or 3 seats and tilt it to the far right. Which is exactly what happened.

And every one of them put their hands on the Bible and said that Roe was the "law of the land" and had 50 years of precedence. And deep down inside, we all knew they were lying. You're a smart guy, you knew it too.

Again, will he push to revisit Loving v. Virginia? Let's let each state decide that too.

Here is where I disagree with you. You are right that the appointed justices said Roe was settled law, and voted to overturn it. The problem is, they never should have been asked that question in the first place. Justices should not be asked how they would rule on a particular case (when is in reality what happened.) The court in general shouldn't be inventing rights or making rulings to achieve a particular goal. They should only rule within the confines of existing law. It's up to the legislature to create new laws or rights, not the court.
