If it were a legal case.

This isn't a question of how evidence in a court case was obtained, wherein if it is found to be illegal it must be ignored.

This is a civil issue between two contracted parties, they have no legal responsibility to abide by the rules of evidence as they pertain to court cases.

that is a knee jerk if i ever saw one...

so we're taking down businesses of business tychoons for undercover private casual conversations that rub people the wrong way.

How many business owners are shaking in their boots after this one. All it takes is a couple of drinks, a talking point, and an iphone recorder and you too can take down Bill Gates....ask him an opinion on a taboo subject and get paid by TMZ.

Never will condone or agree with Sterlings thoughts but don't agree with the severity of this punishment and i don't see how its legal. My guess is Sterling in the end is going to win a legal battle and end up winning in the end unfortunatly.

The best way would have been to boycott the product and make him sell because of lost money. Capitalism folks not Communism...which is what this is...just take it away because he said a bad word....borderline Nazi.

It's frustrating when people act as if sports teams are just the same as normal companies. Nothing could be further from the truth.

The NBA and other professional leagues are a legal oligopoly with a single governing body. Barriers to entry make it impossible for another "company" to enter unless approved by the other owners. Also, given the nature of sports, there is not a large amount of competition for consumers in the USA. If you're a team in a city, it's yours for the most part. It's unlikely many people in Washington cheer for the T-Wolves, nor do they root for different teams on a yearly basis based on success, etc.

In a true business environment, if something like this was said, consumers could choose to stop consuming the product of a company. Sports doesn't allow that. If something happened involving a giant scandal at Clemson, are you going to start rooting for South Carolina or Georgia? Obviously not. Sports allegiances are often born into and life-long in their stature.

Additionally, his actions are costing the league as a whole money via sponsorship and loss of reputation. In a traditional business environment, if a company does something wrong, competitors benefit. In the pro league model, all are punished. For those reasons and more, this isn't an actual business, and this isn't borderline Nazi (what a ridiculous thing to say). It's an example of what is effectively the leader of a cog of a larger machine being forced out for acts detrimental to this machine.

I don't like how this information was collected, and think the woman who did it deserves punishment. But we're not turning into Nazi Germany. Relax.

To my knowledge, there are no other shareholders.

If forced to sell, the team would likely sell for something in the $500 million to $600 million range.

The ban simply means that Sterling himself can't attend games or practices or participate in business or player personnel decisions. Of course, his GM could still do all of these things.

This whole things just reeks. Based on the circumstances surrounding his comments (private phone recording of an argument with a gold digging ##### leaked to the media), I don't think there's a single judge who would be able to take serious action on it.

Thanks for clearing up what "ban" was. All the articles I've read say he's been banned, but don't mention what that entails.

if enough other owners agree to it. I'm not sure exactly what that would mean and what legal action it would require. But that was mentioned on ESPN radio earlier. Apparently that has to be done by the owners and the NBA office/Silver doesn't have that authority on their own.


I guess in theory that if they asked him to sell, the NBA could just not schedule the Clippers any games.

But imagine the "forcing him to sell" course is really just threatening to not continue the charter the team has with the league (based on some rules they have in their charter) that would effectively cause the team to be worth nothing, if he decides to remain owner.

It is much the same rules that are in place that force the NBA as a whole to approve of new owners and approve of sales of teams, etc.

Sterling is a million years old and will never have to worry about money, I don't know how much he cares about the clippers or the nba...but if he did, ouch.

The last time we saw a ban like this was Pete Rose. What he said was unethical, yes...but not illegal or. It was racist, but there is a difference in being racist and discriminating based on race. Racism will be here and has been around for all of time. Discrimination has taken a steep decline, you could argue women's job/pay equality is bigger than discrimination.

This new commissioner is trying to come in and assert his authority. You could tell he was nervous.

If Sterling pursues this from a legal standpoint he will come out on top. Otherwise it's only a matter of time before people are losing their status in life and job due to their personal opinions. Is that the America we are moving towards?

I do not condone his behavior. I think he is a despicable POS, however, isn't this America where free speech allows people to express their own opinions? I don't see how they can ban him for life, fine him nor force him to sell his business all because of some offensive comments. He didn't break any laws, just used bad judgment. At the same time, the players, advertisers and fans are free to spend their money/time on something else not associated with the Clippers. I don't expect him to go down without a fight.

Yes this is America. If he wants to sit on his billions as a citizen and make whatever comments he wants then he is more than able to do that without recourse. The problem here comes in when you work for or within a private organization (NBA). When you do that and then make those same comments you are subject to punishment under their rules and regulations.

Adam Silver is not just the commissioner of the NBA but he is also an experienced litigator and I'm sure the NBA employs some of the best lawyers in the country. If they didn't feel they were well within the NBA bylaws to do this then they would not have. In saying that, Donald Sterling is also an experienced and well thought of litigator and if he wants to go down with a fight he is certainly able to that because as you said, this is America.
