I am not sure why we have to sue the ACC

What will they do if we don't pay the exit fee, shake their fist in anger at us? Maybe they can sell the debt to a collection agency, and we can not pick up the phone.

I think cooler heads will eventually prevail, I see no reason to go to court when the ACC is feckless and weak.

Bob James, commissioner of the ACC, told the Associated Press: "I feel the penalties they enacted were what they deemed necessary for the allegations placed against the institution. I don't believe they made Clemson a scapegoat."

I'm pretty sure the amount of money the ACC is asking for from Clemson...

doesn't even exist in US dollars. Even if we pooled currency from other countries, we would have a hard time getting that kind of money together, and that's including favorable exchange rates. This is a major weakness in the ACC's legal stance, if you are asking me.

I believe the ACC wants to get their hands on Fort Hill and put it on one of those house flipping shows. With the hot real estate market, this might cover the exit fee.

Plus, as a land grant school, we own all those agricultural experiment stations. Land is crazy expensive these days and they'd love to get those too.

I'll take Peter Woods, Page, Capehart and Burley against the entirety of ACC HQ. Cannot predict where the misunderstanding might go from there, but might have to engage lacrosse and softball teams.

If it easy, there would no lawsuit. We chose the ACC, it has great conference for us and we will stay until the entire conference is released which will 10 years or whatever it is. No person with a brain walks away from $40-43 million a year and is given $100 million bill for leaving.

Absolutely suicide for football, if we stay in the ACC for another 5 years.
We cannot compete getting 30 to 50 mill less revenue then big or SEC schools.
it will be impossible for us to compete.

Notre Dame didn't pay an exit fee and they sure had to be an ACC member school to have schedule 10 ACC games in 2020, and they had the same rights as any other member school to play for the ACC championship. But when they took their FB out in 2021 they didn't pay an exit fee, but they did make millions while they had their FB was in the ACC!!!!!!!

These lawsuits are nothing but smoke and mirror preceding settlements which allows the schools who want to leave to do so. The ACC has well prepared to maintain its status as a minor player in the world of football by inviting and signing new schools.

It's a formal divorce preceded by asking the children which parent they want to live with.

All the good kids want to live with papa so mama picked up a few orphans off the west coast.

Now it all comes down to how much alimony is paid.

For example - could a person sell themselves into lifelong servitude?

Apr 5, 2024, 6:02 AM
Reply

A person signs a LIFELONG contract for $10M USD in exchange for their indentured servitude to physically remain/stay within a 1 mile radius attending to the daily, legal chores requested for 24 hours a day, 365 days a year, no vacation or holidays.

Food and water provided. In addition, the $10M fee cannot be transferred to another person, nor touched for a period of 50 years.

Would such a contract be legal and enforceable? Could a person even legally enter into such a contract?

I’m not a lawyer, but my initial reaction is that there must be some sort of law that would prohibit a person from entering into such a contract.

I reference this extreme example to illustrate the GOR contract that the ACC is holding over the conference members, that they willfully agreed to and SIGNED.

Finally, in agreeing to sign such a contract, if the person decided that they didn’t like the contract and sought to seek a different contract with different terms WITH ANOTHER PARTY, the OTHER POTENTIAL PARTY being solicited would NEVER consider agreeing to any other agreement considering that there was what appears to be a BINDING contract of indentured servitude in place, regardless of the questionable legality of that contract.

I would think that Clemson would have to legally establish a nullification of the GOR, BEFORE being able to take their “physical self/services” elsewhere.

Well, multiple lawsuits and judgements against Clemson's various entities

Apr 5, 2024, 9:49 AM

for one. You can't just 'not pay' if the contracts and exit fees are held up in court. Eventually the courts would just take the money.

We have a legal system and contract laws that dictate how it all works. But if Clemson loses, leaves and is in breach, you bet the university will finally have to pay.

But Clemson won't be leaving if it all goes through the courts and there would be a judgement to pay IF they left.

Is it because Clements made the comments about how great the GOR revenue was so he and the univer s ity did not to look stupid when several years later the SEC and BIG got larger payouts! Don't think this is going to play out in the end...courts are not going to overturn contract, copywrite and business law for a few greedy colleges...even if one is Clemson...we are in a sense suing ourselves and that makes little sense as well!

Ask yourself an honest question if you can...If Clemson had been in the SEC for the last ten years would we have won a natty?...With us playing in the ACC we were able to play everyone including the waterboy...develop depth and prevent injuries that would have taken place with a full SEC schedule...like it or not that record helped us to the prom...why leave a guaranteed winner for a pig in a poke...PSU has a great team every year and they can't buy a natty for any amount of money!

Injuries happen regardless of who is lined up on the other side of the LoS. Look no further than Jordan Travis's season ending injury vs North Alabama.

Not to take away from the bigger point - yes, it is harder playing in the SEC than the ACC - but a single school can dominate that league too (see various runs by Bama, UGA, UF and LSU over the last 20 years).
