Sounds like the judge gave the jury an Allen charge- encourage jury to come to a decision today. Paraphrasing but generally" there is not a more qualified group than you to reach a decision..."

That means it's a mistrial unless the judge demands...

a verdict. In that case it will result in a not guilty verdict for those who insist he isn't guilty will hold out indefinitely.
IMO, the jury can't decide whether he get the max or some lower sentence.

The jury does not determine sentencing other than what charge the defendant is guilty of. Sentencing is in the sole discretion of judge

If nothing else, his family will have to declare bankruptcy due to legal fees.

They really should try and settle this

There's no way this should ever have gone to court. It's simple vandalism by a kid. There's no need for a harsh sentence, but there needs to be some consequences. They also need to ensure he doesn't profit from his actions, but that's about all.

5 Years hard time for vandalism with no priors???
Jul 23, 2015, 5:02 PM

That's just revenge, not justice. Vandalism, in some cases can require multiple years imprisonment, but those are extreme cases of multiple offenses with malicious intent. By all accounts, the kid was a Clemson fan. He's got no record. There are no factors other than a lot of angry people that point toward a stiff sentence. A fine, probation, and/or community service are much more appropriate.

He's guilty as he!! and the jurors don't have a clue on a value for the rock. Ditch them all and start over !

Now is when a good judge would have told them to go back
Jul 23, 2015, 5:04 PM

into their deliberations and not come out without a verdict. Then cut the air conditioning off in the jury room.
That's what they'd do back in the day.

Glad that they won't send guy to prison
Jul 23, 2015, 5:24 PM

Vandalizing the rock isn't cool but neither is ruining a persons life by sending him to prison because he was stupid. Make guy work on stadium post-game cleanup crew for 3 seasons without pay. Save prison for more worthy criminal offenses.

He's been convicted of the crime of breaking the rock
Jul 23, 2015, 5:27 PM
|

The value of the rock was just not the same to those on the jury (when they were asked to come to a decision) as it is to us. Eliminating Clemson fans or anyone who had touched the rock was bound to lower that value.
But he still did it, and that will never be a stain he can remove.

Clemson officials should have Howard's Rock appraised and insured for
Jul 23, 2015, 5:26 PM
|

the valued amount. Hope it never happens again but with insurance and an official appraisal of such a valued piece of Clemson if some idiot messes with The Rock again Clemson has a more solid foundation to see the guilty serve prison time. It's not like HR can be replaced.
