Oh what a mess the NCAA has on their hands...

After spending 2 years trying to figure out the NIL issues/recommendations, the NCAA is getting some last minute advice from 3 of the Power 5 conference commissioners (SEC, ACC, and PAC12) to scrap the NCAA developed plan for a new one:
"A working group appointed by the NCAA spent the last two years developing a proposed set of changes that would open some doors for college athlete endorsement deals while also setting "guardrails" to make sure that a clear distinction remains between college sports and professional leagues. The guardrails include rules that, among other items, prohibit schools from partnering with their athletes in NIL deals, require athletes to disclose the deals they sign and prohibit athletes from endorsing some types of products such as gambling websites or tobacco.
Members of the group that created that framework included Big 12 commissioner Bob Bowlsby and Ohio State athletic director Gene Smith, one of the longest-tenured and most respected administrators in the Big Ten. On Friday, their colleagues from the SEC, ACC and Pac-12 (as well as three other leaders from smaller conferences) asked the Division I Council to consider a new plan instead.
The new proposal directs schools in states that have impending NIL laws to follow their state law. In the 40-plus states that are not currently on pace to have laws in place this summer, each individual school would be responsible for developing and publishing its own policies for what kind of NIL opportunities their athletes can pursue. The only guidance to schools in creating those policies would be: (A) don't allow school employees or boosters to pay athletes, and (B) don't allow payments in exchange for athletic performance or recruiting inducement."
Looks like all these different State NIL laws is making it darn near impossible for one set of NCAA NIL rules to be applied to everyone. Lots of blame to go around on how college sports has driven itself to this NIL free-for-all dumpster fire. One thing is for sure - gonna be plenty of lawyers getting rich from future lawsuits dealing with this stuff...

Clemson will have another new department for NIL compliance, for example. To me, the more LEGIT money you make under NIL, the more scrutinized it will have to be by nature. Receipts, affidavits, even NFT's, if a school DOESN'T try to enforce compliance, they'll not just fail but they'll easily be proven that way & the consequences could be tremendous & swift.
I think it's more likely places like Clemson follow every penny & make sure everything is documented as best as possible, such as training their kids & agents to use only approved methods of payment (i.e., no cash) & creating specific paths for all of them, such as a dedicated app like Venmo.
Then if there's (illicit) cash involved, that's on the player, rather than bringing down the whole program faster than you can get crab legs from Publix...

They will either have to file a schedule C or start filing quarterly to keep up with the taxes. When students realize that they have tax implications, look for management firms to step in and "help" them for a fee.

Yep, they'll have to pay taxes rather than just the rich old guys running the whole thing making all the money.
But Clemson will help them do all of those things, too; the compliance department already gives multiple mandatory coaching classes, now they'll have to add in stuff to cover NIL & anything associated with it so the players aren't just giving away all the money (including the taxes that come with it).
Who knows? Maybe they'll get to work with a former Clemson player who creates a firm to help with this kind of stuff? We have a great business school, after all; it's got its own skyscraper in downtown Greenville even (I love that place).

Personally, all the more reason to be happy about this change.
Some people just want the rich old white guys to continue to make all the money because that's the way it's always been. I'm not one of those guys I guess. Nice to know I'm not alone.
I don't know how this is all going to work out, but I just can't see it as total doom-and-gloom. Still, it was a rights issue all along; it had to change, whether we love it or hate it. I just can't imagine Clemson won't move into the future backwards----frankly I think Clemson will excel here, too.

Certain areas jumped on board NIL immediately in order to set their own standards and hold an advantage over others. This won't and can't be handled by the NCAA. It is not equipped for it and never will be. The NCAA is utterly useless at this point.

I'm going to continue to be a Clemson fan personally. I hate that so many fans will never watch college football again, but I'm glad they had a good time before 2021.
But this NIL thing was always a rights issue. Can't fight it; it's happening.
I'm not the guy who wants rich old white dudes to keep making billions off the backs of our football players while they make zero, but I understand that's what a lot of fans want to keep. I'm hopeful instead Clemson will find a way to work with these new rights. Fingers crossed I guess.

I didn't mean to be confrontational. That's not my game, FWIW.
All I'm saying is this was always a rights issue; we got used to it because "that's how it's always been," but now it's finally changing.
Some people will love it, some will hate it & insist college sports are dead, but yeah, I think the same people making all the money & the players not being even close to fairly compensated now finally changing is something to celebrate.
Bottom line, we all just kinda "got used to it." I don't know how things are going to change, but I do think the next generation of players will look back and wonder what took so long (& the more I think about it, so do I).

The horse has already left the barn! The Florida state law that goes into effect in 9 days will allow students to have agents. The federal law may well make that legal nationwide, over-riding all state laws.
We will see an expansion of agencies that will be targeting high school kids, and probably sign many before their junior years. Imagine the endorsements Zion Williamson could've gotten as a 16-year old.
And those agents will seek to sign those kids to long-term deals that would see them representing them from high school, through college and into the pros. Those agents will invest heavily is market development to create NIL sponsorship deals for those high school and college athletes. And the highest bidder always wins. I worry most about individual boosters that also own local businesses paying for a kid to go to their school. But, honestly, the bigger impact will probably be with Nike, Under Armor and Adidas paying kids to go to 'their' schools that wear their jerseys and shoes.
Suddenly, kids will be choosing (as opposed to being drafted) to the school with the best financial deal. Every 5* will be an unrestricted free agent and teams will have no salary cap. You will see a MASSIVE gap appear between the Haves and the Have Nots. I can't help but think that Stanford (with so many billionaire alumni) could easily leap to the to top with a little effort and a big budget.
This is neither good nor bad. It's just something new. I miss the days of school pride and making a decision based on things like environment and education. But this could be entertaining as well. Time will tell if we've ruined a good thing or made it better. One thing is for certain... those 5* studs with monster contracts will be driving exotic cars and throwing massive parties very soon.

As long as payment to student athletes does not come from either the NCAA or the individual schools then they don't care. Both the NCAA and the individual schools need to protect their cash flows and meet their budgets. If deep pocket boosters, agents or shoe/apparel companies want to pay students, which is what they do now, then that is fine with both the NCAA and the colleges.
Like I said, as long as the NCAA and the colleges keep getting their cut they are more than happy for the students cut to come from other sources....

It won't be all Nike & rich old dudes controlling the NIL, though.
Trevor Lawrence, for example, didn't need a rich booster to just give him money---WE would have done that.
Imagine instead of the owner of Mitsubishi paying Trevor to put his name on a car, a local restaurant like Vangeli's on Ram Cat Alley can host Trevor for a night signing hats for a fee-----WE buy the hats, Trevor takes the money, Vangeli's doesn't pay him but just sits there and enjoys it with us. Would you be more likely to buy a Darien Rencher hat KNOWING he will get most of that money himself?
The opportunities in the past were limited; the opportunities from NIL are so vast I don't think we've thought much about how great they can be at taking money OUT of the rich boosters & corporate owners' hands & putting it back in the players & local businesses' hands, so to speak.
That's not to say Trevor wouldn't get bigger checks than most, only that it's not all going to the same people as it has for decades. We've been paying Mark Emmert & Bill Bowlsby enough for too long.

Sure Trevor can spend a night in a restaurant signing hats for $10 a pop. But why do that when Mr. Deep Pockets will pay you $5,000 to come to his car dealership and stand around for an hour. Or a group of guys pooling their money an offering athlete Y, $100,000 to leave Ohio State and come to Georgia to play for a year.
I think where this is all heading is in a couple of years these athletes won't even have to attend class. I think that requirement is going away.

Instead of embracing and controlling change, it tried to keep the genie in the bottle. It's been obvious for years athletes would gain the right to be compensated. The NCAA could have maintained control had they moved forward before legislatures felt compelled to act. But their idiotic attempt to keep the status quo blew up in their faces.
I'm actually going to enjoy some popcorn watching things play out.
I believe they learned from the blunder. This is why they loosened up the transfer portal. Lawsuits and the courts would have shoved it down their throats anyway.
IMO, it's also a secondary reason they will increase the playoff to 12 teams. The Group of 5 was going to lawyer their way in. Of course, money is the primary reason but 12 teams (11 games) yields more revenue than 8 teams (7 games).
I do not have the impending sense of doom others feel. Major change is scary but chill out. It'll sort itself.
The real danger to CFB is the NFL lowering the college requirement below 3 years to 2 or 1. THAT could kill the product. Fortunately, won't happen anytime soon.

Sure, but do the Power 5 conferences really want this to happen? IMO, they like hiding behind the curtain while controlling the puppet (NCAA) that is out on stage taking abuse from everyone.
Another reality: The Power 5 don't want to cede power to a truly independent organization they don't control. This scares the daylights out of them.
IMO, the Power 5 must openly admit the NCAA is just a front organization they control. This would be a first step. The big step is junking the NCAA for a brand new, empowered organization that could act decisively instead of being paralyzed by fear of offending it's patrons.

I think you're right in that this was always inevitable and surprisingly overdue.
I don't know what to expect, only that change is coming. I just can't imagine it spells certain doom for college sports, especially football, but I wouldn't be surprised if some of the rules change even if the implementation of them doesn't, like 2-year scholarships but a player like Trevor could skip college entirely & get paid to sit on a bench in the NFL for a few years.

It would not surprise me in the least if we see the end of college athletics in the near future. With the demands by athletes that they be paid as "employees" of the university, I can see the NCAA and, at the very least, the smaller and less viable universities across the nation just say "Screw it! We're out of the athletics business and will become an academics only institution." Let the NFL, NBA (expand the G-League), WNBA join the ranks of MLB and NHL by starting up their own "minor leagues" so they can draft the high school athletes directly into those development programs for a few years before they move up to the big team.

this sounds like the incoming athletes need all need basic accounting and economy classes to keep up with this. The bookkeeping will take up most of the free time they will have available.
