DT Special: Gov. Nikki Haley should sue the ACC

May 22, 2015, 9:44 PM

for its ban on the state hosting pre-determined post-season events and tournaments because of the flag of the Army of Northern Virginia flying on State House grounds. The NCAA is the big one but start with the small fish first. It's likely an unconstitutional action directly interfering with business practices and a people's welfare, and I'm not sure they could justify maintaining it. I think Nikki could take Johnny down on this one. It'd be a great show.

odd thing is they had no problem holding the ACC Rowing

Championship in Clemson this year. Same thing for ACC Track in the past.

Those could have been performance-based hosting sites,

May 22, 2015, 10:11 PM

which is how we continue to host NCAA BB regionals (sorry, used to host) where decisions are made post-season. If not that, the league should own up based on where they've last stated their position to be and apply it across the board.

You don't seem to like the free market

May 22, 2015, 10:20 PM

Are you saying the ACC/NCAA should be forced to hold events in South Carolina?

flag link military_tech thumb_downthumb_up

no, they should stop being weenie-spined hypocrites

May 22, 2015, 10:29 PM

why will they hold the ACC Rowing or Track championships in SC, but hide behind the bogus NAACP boycott when it comes to having the ACC baseball tourney in Greenville or Myrtle Beach?

badge-donor-05yr.jpg flag link military_tech thumb_downthumb_up

Wow. The league is more two-faced than I realized.

May 22, 2015, 11:37 PM

We've got an outstanding rowing facility able to host many teams. So they're publicly (2009 decision to cancel Myrtle Beach and send it to Greensboro) making a statement but behind the scenes going for under the radar convenience.

I wonder what SC has missed out on in revenue and income based on the ACC's prime time ban.

As for free market, this is exactly what I'm advocating. Let us outbid and outhost competing sites on a level playing field. We're doing that now in rowing it seems, and the league is OK with it. But when it comes to the TV sports - no dice. I bet our AG can prove what the ACC is doing with their ban isn't legal. Interstate commerce issues. Free market. Tigers.

On campus sites like rowing and track are not covered by the ban, only off campus sites are banned.

How is it unconstitutional?***

May 23, 2015, 1:57 PM

flag link military_tech thumb_downthumb_up

Ironically enough it may go against the 14th Amendment.

May 23, 2015, 4:13 PM

It's been expanded through the judicial process to include Federal laws, has been interpreted to include groups, and with the league operating in interstate commerce, it's highly unlikely that it could be allowed to discriminate based on ideology, which is what the ban represents.

I'm neither a lawyer nor constitutional scholar, but I bet the Gov has some of each on her staff that could find enough to warrant a suit. Our state contributes public tax dollars to benefit one if its institutions, and thus the league overall. Take on the ACC first, pound Swofford a good one, then set up for the NCAA next.
