What is known:
“The injuries the mail carrier sustained in this crash are severe and will require several months or longer for recovery,” police said it the Sunday statement.”

“Davis was unable to stop due to his speed at the time, police said. The football player is accused of driving 115 mph in a 55 mph zone.

The force of the impact caused the mail truck to flip over into oncoming traffic. Two other vehicles then collided with each other while attempting to avoid the mail truck.”

“Reckless disregard. Basically, a person acts with reckless disregard for the safety of others by knowingly doing something that poses a safety threat to other people. In other words, the person knows the conduct is dangerous but decides to do it anyway.”

The mail person may not be out of the woods with her recovery. If she succumbs to anything going forward, there can be a case, she would not have, if not for her injuries. She could still have a blood clot or something similar that is undetected.
A simple arthroscopic surgery and CJ Fuller passed (God Bless him and his family)

Fred Davis knew wrong from right. He CHOSE to do what was not right. A person was severely injured. At a minimum they have to live with the scars and pain of his wanton disregard.

Flame away. If it happened to you or one of your loved ones, would you be saying, “Boys will be boys.” Or everyone was young and dumb at some point. Geesh… the lack of self awareness permeates.

young. I never physically injured anybody as far as I know, though I easily could have. No excuses, I was wrong, and should have paid the price had I been caught. Same goes for Fred or anybody else. I had some close calls, thankfully had good parents and good support system, and I learned from it all. I hope Fred does too. It's not an excuse at all, but it's just a fact that people that age often make stupid choices that they wouldn't make later in life with the benefit of maturity and life experience.

our vantage point. While we all did things like this - I too drove a car over 100 mph at about his age, and did a number of similar things - I hadn't committed to helping a team of folks pursue goals that were inconsistent with that type of behavior. I hadn't promised people who were investing in me to show up every day, and to do what was necessary to do so. So, there is normal-if-stupid behavior on one hand, but promises and commitments on the other.

What this means for Davis and his position on the team we can't know, because we don't know whether this was a one off or a pattern. Only Dabo and a few others know, and Dabo has done the right thing in similar situations.

I can say that if I was one of the injured, or family of, I would not be in a boys will be boys attitude - by rights they should be dead - and the prosecutor has to represent them. So we'll have to see.

which is a misdemeanor in SC, so from a criminal standpoint, he'll receive a citation, pay a fine, have points deducted from his license, and that will be the end of it. To my knowledge, there are no other criminal charges pending.

From a civil standpoint, the victims may file law suits for damages (property damage and/or bodily injury), but all of that would be covered by insurance which is precisely why everyone is required by law to have it.

you can't impose a punishment that is greater than what the law allows. Do we wish we could, especially if you're that woman or her family? Most assuredly.

While there are a lot of nuances, from a civil standpoint, his excess speed merits punitive damages, so a jury (should it ever come to that), could slap him with a judgment that may take him the remainder of his life to pay.

Insurance only covers up to the limit purchased by the insured. The vast majority of SC drivers have 50-100-50 (or less).

I just looked up reckless driving in Georgia. The serious injury part changes the charge from a misdemeanor to a felony. I believe the Davis wreck will be used as an example to get the current felony bill into law in SC. As it stands now, this is a misdemeanor. Clemson has a handbook that outlines punishments for misdemeanor charges. Dabo will handle this appropriately.

Fans being fans. Doesn't matter the specifics.

Player of school A does action Z
Fans of school A look for reasons to mitigate Z.
Fans of school B (rival of A) look for ways to intensify Z.

I lived it just a few years ago with Jamies Winston. FSU fans were continually paining him as a "great young kid who just made a few minor mistakes and is misunderstood."

I don't have to read a coot board to know what they are saying about Davis. And if Davis wore a crimson or black jersey on Saturdays I think I have a pretty good idea what folks on this board would be saying about his actions.

It's just fans being fans. Nothing objective about the way we look at things. Every fan, to some degree or another has tinted glasses when looking at the world of sports.

You'll confuse the ones who post with emotion alone. There's lots of them.

It doesn't matter what any of us think about Fred. He messed up and will have to face the consequences of his actions. Dabo will determine whether he ultimately gets to play again. The insurance companies will handle the money. A small court will handle what happens with his license, any community service, ect. The final outcome isn't clear yet but you can pretty much bet on his insurance premiums skyrocketing.

Your A fans and B fans thing is spot on. All the grandstanding now is just risking people looking like idiots: there's folks hoping a dude that drove 115 mph and put someone in the hospital gets off with a slap on the wrist, and there's folks hoping his life is entirely destroyed by this accident. An accident which he is 100% at fault, and will face consequences, but an accident nonetheless.

The best thing to do imo is to just offer up prayers for any injured parties and then move on, reading other news while waiting to hear how this plays out.

Exactly. There would be no "boys will be boys" or "the coach will handle things" comments if it was a coot or any other rival that did this. Good to see that a decent amount of posters have shown some objectivity with the seriousness of this action.

Brett, I agree with your comments though I have to put Winston in a different box. Guy is a thug. Spoiled athlete never held fully accountable after multiple infractions. Nothing he was guilty of could be considered an accident. While I see Davis’s actions as beyond stupid and criminal at that, I can assure his intentions were not to have injured another person. No excuse and he should suffer the consequences of his actions accordingly.

Where did the 115 come from? Was he actually timed.?

In any event this should not happen. No way can we support the kid in this foolish event. Let’s hope that those Injured heal completely and quickly. Dabo will do what he has to do.

They can figure out speed based on the length of the skid marks, as well as in-vehicle data about distance over time. Larry Williams from TI tweeted the police reports and they go in-depth how they calculated speed.

Everybody keeps throwing out that "insurance will take care" of the postal worker. First, do we know how much liability insurance the young man was carrying? In Ga, you can have a minimum of $25,000 coverage and be legal. I'm not sure what it is in SC but my point is I don't think we can just assume a 20 year old was paying for hundreds of thousands of dollars worth of liability coverage on his vehicle.

workers compensation insurance. That coverage would be primary and the WC carrier would then subrogate against the responsible party or the liability insurance carrier for the responsible party.

You do bring up a good point about the limits or amount of coverage a driver may have. Minimum liability insurance limits in SC are $25,000 per person and $50,000 per occurrence which is pretty low (that amount used to be $15,000 per person and $30,000 per occurrence). That's why drivers are offered and should also carry underinsured motorist coverage as well.

That said, it's a safe assumption that the car was insured by the kids parents and carried more than the minimum limits required by law.

but if you have a college age kid driving a fairly new Dodge Charger, and you're only carrying minimum limits, you should have your head examined because you've clearly lost your friggin' mind.

I get it though. In many cases, the cost of the car breaks the bank so minimum insurance limits are all that's now affordable.

I don't think anyone should be playing it down. This one is pretty bad. Someone was seriously injured. What punishment happens to Fred via dabo is not as important as him making the postal carrier as whole as possible afterwards. That would be the right thing to do.
