IPTAY and NIL

I am a long time IPTAY donor and I do not know the answer to this question. Is IPTAY totally separate from CU? IPTAY is the grandfather of crowdfunding sports. How can the structure of IPTAY be modified to work with NIL? Can IPTAY have an NIL section and contact an athlete about NIL opportunities?

Effective: July 1, 2021 (moved up from July 1, 2022)
Rules Include: Athletes may receive compensation only for third-party endorsements, non-athletic work product, or activities related to a business that they own. NIL compensation may be provided only by a party not affiliated with the athlete’s school and cannot be based on athletic performance or used as a recruiting inducement. Athletes cannot use school intellectual property, facilities, or uniforms in NIL activities. Athletes cannot engage in NIL activities during academic, athletic, or team-mandated activities. NIL contracts must be disclosed to the school before they are signed. Athletes cannot endorse alcohol, tobacco, gambling, illegal substances, or banned athletic substances

be involved with NIL. Can it direct students to outside NIL opportunities? Can it provide NIL opportunities? I imagine IPTAY would have to be fair with what and for who it provides.

at a recruiting class in NIL deals.............there may be "rules" in place against it, but there are loopholes around it and nobody around to enforce the rules.

just look at TAMU & Texas.

Thanks for posting this. I just wonder how feasible this can of worms will be to monitor. I see no good way to fairly police this, and the big get bigger, and the rest may as well forget about it as far as influencing or enticing a really talented athlete to come to their school. I see this becoming "all about the Benjamins", and zero chance of any meaningful monitoring.

there are loopholes upon loopholes upon loopholes throughout ANY NIL lipservice "rules/regulations".............not to mention NOBODY is here to enforce ANY of the rules.

Boosters are driving NIL deals and yes the universities are involved, but are able to spin it around the said "rules"

Even though Clemson is unable to compete with the elite anymore regarding NIL, I do hope that IPTAY and the University at least TRY to structure some deals..........if not the end of Clemson football is closer than we think.

fund raising organizations in the State of SC (i.e. IPTAY, Gamecock Club) are prohibited by SC Law in doing the kinds of NIL activities a lot of people on here suggest.

The problem in College Football is that every state is passing their own NIL laws and no two are the same. The NCAA has all but given up on policing NIL and has told it's member colleges to just follow their individual State laws. Most State NIL laws share a common framework but as others have mentioned - "legal" work-arounds to the individual State laws are all over the place and NIL is quickly becoming a BS facade for just openly paying players.

The way most are getting around the various laws is through private crowd-funded organizations (not associated with the official University athletic department booster clubs) whose stated purpose is to collect money from donors to "provide NIL opportunities" to the players with no expectation of a monetary return on the money they are giving the players. For instance the "Horns of Texas" organization is paying every UT scholarship offensive lineman a $50k paycheck to "make appearances" supporting a charity. So to get paid, all a 3rd string Texas scholarship offensive lineman has to do is show up to one charity event for 10 minutes, shake a few hands and get paid $50k. The "Horns of Texas" doesn't really give a crud about helping charity - they are just using this as a means to pay Texas players while sending the message to recruits - come to Texas and you will get paid. Other schools are following this "model" and even USuC has started with "Garnet Trust".

If there are a few rich mega-donors that want to put millions into one of these organizations and use it to buy the best team possible there is literally nothing right now to stop it from happening. Welcome to the corruption of college football where NIL is becoming nothing but legalized bagman activity.

I'm just hoping that enough boosters will get burned by paying out big money to guys who play poorly or bail out for more money that the whole NIL thing will lose its appeal. So I pay some completely ungrateful QB $1M for some phony endorsement deal and still don't make the playoffs. Then the next year he hits me up for a raise! If I don't cough it up, he transfers and accuses me of slavery. How long am I gonna do that before I just decide to save my money? For a football boosting fix I can just build a new HS stadium or something instead of giving money to a bunch of jerks.
