PSA - don't do what Buckeye backup QB did

We may not be able to get away with it like he did. Ohio State backup QB Jack Miller was pulled over for crossing lines and refused a breathalyzer test. The charge was eventually reduced to a traffic violation and he was reinstated just ahead of tomorrow's game with Michigan State.

Refusing to take a breathalyzer test doesn't keep you from getting a DUI and a DUI charge can become a felony for multiple violations, bodily harm, child endangerment, and breaking other laws. I hope and pray everyone is safe and responsible for the remainder of the season and during the holidays.

Btw - Before anyone brings up Fred Davis, there was no revelation of alcohol involvement, and he was charged per law for excessive speeding and causing the accident. I agree that the law should be stricter when injury (maybe severe in this case) occurs.

We don't use a breathalyzer in SC. We use the Datamaster....at the detention facility. So once you make it to being offered to give a breath sample, you've essentially already been charged. Refusing to do field sobriety testing roadside usually gets you arrested for suspicion of DUI. I say usually because it can depend on the agency and officer, but 99% of the time you will be arrested for refusing.

I have heard that it is always beneficial to refuse any field test for DUI if you feel that you may fail.

The impending arrest, paperwork, drive to the police station, and any other time wasters that happen along the way give you time to sober up and improve your chances of passing any of the tests given once arriving at the station.

With that said, do not drink and drive.

All attorney's say to never summit to a breathalyzer that records your blood alcohol level, and most of them won't take your case if you have summitted to a blood alcohol test...

If you take the breathalyzer, and it shows .02 or higher, I think you're going to jail. If you refuse the breathalyzer you're going to jail. IMO, if you have drank more one beer, you're better off refusing the breathalyzer. At least without actual proof you were over the limit, an attorney has a chance of getting you out of a DUI charge that stays on your driving record for ever, I believe!!!!

You can drive with a BAC of up to 0.79 in SC. If any of you have a breathalyzer you know .08 (considered legally drunk) usually doesn't even constitute a buzz. Driving while tired or texting while driving is much more dangerous than driving with a .08 BAC.

I'm not advocating drinking and driving but it's largely a money grab. When BAC gets over .15 most people are fairly intoxicated. I've seen people at .3 who functioned fine. It's very subjective from person to person and largely depends on their drinking frequency (tolerance) I have a medical background and have seen quite a bit.

Don't take the test if you've had anything to eat or drink other than water for an hour. The police say 30 minutes, but that's to protect the machine. It's based on thermal conductivity to tell the difference between air/CO2 and air/CO2/alcohol, but lots of other chemicals will trigger it. Diabetics have failed the test from ketones in their breath. If the temperature of the gadget is too far from 68F, that can also cause a false positive. If you want to comply, do a blood test.
