wasn't the burden of proof a lot lower in the civil case? is there a jury or just a judge?

I'm an attorney. They already nailed it. In a civil trial, you have to be more sure than not that someone wronged the other. So 50.1%+ (there's also a standard called by clear and convincing evidence, but it's not relevant in this particular situation). In a criminal trial, it's beyond a reasonable doubt, which doesn't correlate to a set number (and is up to the individual juror), but is basically where the state proves that there's no other logical explanation for what happened.

As for jury vs. judge, that's up to the parties. That's the same with criminal cases, as defendants' may waive their right to a jury trial if they so wish.
