UPDATE regarding tiger paws on the roads

There was some discussion about this on Monday, and I emailed Governor Haley's office about this issue. Unfortunately, they got in touch with DOT, and the answer was not good. It looks like this tradition may die unfortunately unless a group does some "unauthorized" painting. What a shame.

Dear Mr. Williams:

I was asked by Governor Haley's office to respond to you concerning the request to paint Tiger Paws on US 123 between Easley and Clemson after the recent resurfacing project completed in that area. I am the District Engineering Administrator for the Upstate area and am responsible for SCDOT's highways in this region. I regret to inform you that we cannot allow the painting of Tiger paws on the highways on US 123 or anywhere on the state highway system. We cannot allow for the installation or painting of anything that is not approved by our SC Manual for Traffic Control Devices. When non approved items are installed in the rights of way, it tends to distract drivers and can cause a safety concern. To my knowledge, SCDOT has never allowed the placement of the Tiger paws in the past but they were painted without our knowledge or consent.

As a fellow graduate from Clemson University and a current Clemson Dad,it is difficult to pass this along to you but we must abide by all the federal guidelines with regard to traffic control devices. I trust you understand our position in this matter.

I have been saying for years now that one of the fraternities needs to step up and start painting again. I know the original frat isn't going to because they will be the first one questioned but someone needs to.

I cannot tell you to paint these paws. I graduated from CU and would love to see them go back up. Get some college kids up at 3am and tell them to do it.

It takes 5 minutes.

that email response is 100% a complete lie. Call up Tom Winkopp and he'll get it done. I emailed him a year or two ago when they looked bad and he had someone paint the paws. Considering the highway patrol came out when they painted them and helped block off the road for the paws to be painted the email response was an obvious lie

Just be because someone knew someone in SCHP doesn't mean the response is a lie. My wife and I have a few friends who are sled agents. I'm sure we could get them to help us do a lot of civil things we shouldn't do.

The SC Manual by statue appears to adopt the Federal Statue. A brief scan of the Fed MUTCD does not appear to specifically prohibit the Tiger Paw but specifies how traffic control signs/markings are to be used to meet Fed requirements. I'd ask the official where the specific prohibition is in the statue before bailing. Of course if there is no one to do the painting then the point is moot.

Here's a section of the SC Code regarding markings - please note that it continually refers to traffic control markings/sign/etc. - the Paw is none of the above!
SECTION 56-5-1020. Unauthorized signs, signals or like devices prohibited; exception; removal thereof.

No person shall place, maintain or display upon or in view of any highway any unauthorized sign, signal, marking or device which (a) purports to be or is an imitation of or resembles an official traffic-control device or railroad sign or signal, (b) attempts to direct the movement of traffic or (c) hides from view or interferes with the effectiveness of any official traffic-control device or any railroad sign or signal, and no person shall place or maintain nor shall any public authority permit upon any highway any traffic sign, signal or control device bearing thereon any commercial advertisement. This provision shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information and of a type that cannot be mistaken for official signs. Every such prohibited sign, signal or marking is hereby declared to be a public nuisance, and the authority having jurisdiction over the highway may remove it or cause it to be removed without notice.

The Citadel blue Paws were repainted on Hagood avenue recently when I worked there from 08-10. Must have been done by the Cadets.

Is it that hard to read between the lines on this one? Legally they can't officially endorse it, so what he's saying is "don't tell us about it and just do it like you've been doing it in the past." At least that's how I read it. I don't suspect SCDOT is going to come behind someone and scrape them off.
