Surreal - For someone that has trampled over the US constitution for his entire political life and supported candidates that have ignored it completely to hide behind when it suits him

It’s a pretty liberal interpretation of the 5th amendment to say that a guy that decided to take the stand had his constitutional rights violated because the prosecutor asked him why he lied and why he didn’t tell the truth to investigators.

Also the argument that the inclusion of the financial crimes forced him to testify is absolute baloney!

Once a defendant voluntarily takes the stand in a criminal trial, you have waived your 5th Amendment right against self-incrimination. All questions are fair game.

I don't think that's true. Your pre-trial silence is still protected and can not be "used against you in a court of law"

you can still invoke the 5th to any particular question(s)...

but then the big risk is how would a jury interpret that?

the stand. The Rittenhouse case was a prime example when the Judge sent the jury to the jury room and ripped the prosecution a new one.

Harpootlian lost the case and he must blame some one or some thing. That is what today's liberal Democrat agenda does and he is their King here in S.C. I am so glad our children did not want to become lawyers. As Franklin said, if it weren't for lawyers, we would not need lawyers. I know there are some good ones out there but it des not appear to be many. As the joke states, "What is one thousand lawyers at the bottom of the ocean ? A good start".

but what I remember about the Rittenhouse case is that he had been asked a question early on, to which he took the 5th. The prosecution then tried to use that against him. In the Murdaugh case, the prosecution asked - as best as I remember - why he didnt tell the sled about Paul's cell phone video. The fact that he hadnt ever pled the 5th on that matter - he was asked only why he didnt volunteer information - might not determine whether it's a constitutional issue, but I think the intent of the question was to show that he was (1) claiming innocence while also (2) lying about being at the scene. I am no lawyer, but it seems to me that the issue isn't what he didnt reveal, but the inconsistency of the two claims: both cant likely be true. That he claimed to not be at the scene is well known regardless of his silence re the video, so I think the state will argue no rights were violated. If I were Harpootlian I would be making the same appeal, but it doesn't seem to be a big deal to me. But I've been wrong a time or two.

Here's a guess: Harpootlian will keep making appeals until his fee equals the value of Moselle and the beach house.
