Thought y'all might be interested. It doesn't appear that either FSU or the state government is going to slow play this or just let nature run its course.
Hopefully, this will have more clout than a typical NCAA sternly worded letter.
ACC doesn't just have an institution of the State of Florida after it. This is a separate action by the state government itself.

FSU, like the other instituions in the conference, signed that god awful contract that stipulates the GOR clause in it. They are screwed just like the other programs that want out....stomping their feet crying about it will not get them released...If FSU or any other school had a way out they would have done it 2 years ago...They're stuck!

I don't see anybody stomping or crying. They are merely trying to find a way out like all of us. The other schools are waiting to see what happens. Fla. St. is the guinea pig. What happens to them will determine what the other schools do.

Actually the fight in court on one point is that in fact the schools did not sign off on at least the latest extension.
And at a minimum the ACC relayed bad information to its constituents in order to finalize a contract that benefited the ACC not its teams (or at least your player teams like Clemson, FSU, UNC)

It shows how little you know to think a state is bound by the same rules of contract as a person. Not only are there contract laws in place that are different, and loopholes in the contract itself, all Florida has to do is pass a law saying that Florida may not be sued for breach of contract etc. etc. Then sovereign immunity kicks in and they walk away scot free.

Again...all of this trouble instigated by ESPN, SEC and differential money paid by ESPN to conferences based on perceived or real differences in teams/rankings/championships etc...why is FSU not suing ESPN to get all of this out in the open...Disney has lots to hide...confidentiality clauses are probably required to keep ESPN & SEC folks out of jail...go back and look at USC, Ark., Misery, now OK and TX and what was promised to make them compromise what little integrity they had...After Texas roasted A&M for fleeing the big 12, that crow must have been nasty...now there is no diff between the quitter aggies and the castrated longhorns...Okies will be Okies and Venables looks in shock...IT'S all about the money! Again Seminole should sue Mickey Mouse!

The ACC will slow roll the release of anything. There will be subsequent letters demanding the documents. Then there will be additional threats of lawsuits, followed by actual lawsuits. This won't be resolved anytime soon.

I'll be very surprised if this law suit bears fruit. In my opinion, the only way out of the ACC/GOR is for the majority of schools to band together. Apart from this, the signed contract seems pretty air tight.

That is exactly what I was thinking. There could be documents that has been held back by the ACC that wouldn't fair well for the ACC in a civil case, and the best way to find out, is for someone to ask to see all document pertaining to the G O R that was originally signed by the ACC and ESECPN.
The Florida attorney general is wanting to have all documents opened up to see what falls out bc the ACC can hold back anything that hasn't been ask for if it could hurt them!!! That's just like a person don't have to prove their guilty, it don't work that way...

institutions. Disclosure to the general public considered. That's akin to the state leasing a building and keeping the lease agreement from the public. The least that we can expect is to gain access to the GoR.
I think every fan of an ACC team would want that to be public. I know it will cut down on lawyers' fees for travel to the ACC offices. I'm sure there are hundreds of lawdogs from the ACC teams wanted to succeed from the conference who would relish the opportunity to get involved by contributing their knowledge to the suit free of charge.
With all the other documents they are seeking they may suspect something less than good faith going on with Disney, ESPiN and the ACC management.
I hope FSU strikes the ACC with such a blow which is so vile and hostile that it is a certain deathblow.

I haven't seen any other conferences make their contracts public either. I mean, I'd guess if anyone made a FOIA request it would have to be granted, but otherwise I've never seen any other league release the contract unilaterally.

Could an ACC member, DISBAND their FOOTBALL program for ONE YEAR, effectively nullifying that institution’s participation in the ACC schedule? Would this BREAK the GOR for that ACC member? Then, AFTER the breaking of the GOR, RE-INSTITUTE the football program the year after?
I know if may sound a bit over-the-top, as well as DRASTIC, but if an institution was liable for $600M by leaving, wouldn’t it be cheaper to DISBAND for 1 year and lose $150M?

This is the first step to get these documents. If the ACC refuses to cooperate and hand over all the documents requested in a timely fashion, the Fl AG will then subpoena the documents by getting a court order. The law is on the side of FSU and the Fl AG since Florida state law requires the documents are public records and must be made available to FSU. Every state in the union has this law.

The letter is not meant to be a threat or whatever. It is a request from the Florida Attorney General, who is the highest ranking Court official in the State of Florida and whose office controls and supervises all of the state court personnel in the state of Florida. The State AG carries a lot of weight and is not to be ignored. He has requested documents covered by Florida State law and cites a court case which has been judged to support what documents he is asking the ACC to hand over. It is not an idle request and if a subpoena is needed, it will be issued based on case law.
The ACC will hand over the documents or the ACC commissioner will be found in contempt of a Florida court order if a subpoena is issued.

I'm not legally a lawyer, but a query for my squire peers...but I'm assuming the state of adjudication is NC with ACC headquarters. How do typical State v. [Private Entities (which I'm assuming ACC is)] play out across state lines, is that a federal proceeding?
Also, I think it is interesting part of NIL is that the Student Athlete is not able to use/reference the school's brand as part of their official 'media' or whatever...It would be interesting if a member school could claim NIL rights against a conference, and ergo slip out of the media rights deal.
Either way, FSU ends up under some contract with ESPN (just like all of us until the Mouse goes down).

The GOR is why Texas and OU are still in the Big 12. Would make them kind of the original Guinea Pigs i guess. They were at least able to settle for 100 million to the B12 to enter the SEC one year early next year.

I had read (I think in TNET) that the State of South Carolina had similar laws regarding public institutions funded through the State, such Clemson. Further, that if any contractual agreements were financially damaging to those institutions, South Carolina can void those contractual agreements.
I may be wayyyy off base but, I am eager to see this move forward.

SC require publically-funded entities to release documents by request. However, it only applies to docs that "exist" (my word). If a copy of the GOR is not held at the university, maybe FOIA laws do not consider it in existence at the university. That ditinction is beyond my depth on FOIA.
Either way, it's poor business not to have a copy of a contract you've signed.

The GOR was a bugaboo from its inception, its extension a creation by Satan himself, and something I was never in favor of agreement by Clemson.
The entire matter reminds me of the shenanigans that we faced in the early 80's with that penalty extension that the Conference claimed was solely crafted, created and imposed by a bunch of faculty reps to the ACC. Horsefriggingsh*t!

Why is it that when there is rape, assault, theft, illegal money changing hands and manipulation of local law enforcement by university officials the state of Florida could care less but when a school Welch's on a contract and claims fowl there is more movement than a GIs bowels on Guadacanal!
