I would have thought we’d go after incompetence, dereliction of duties, etc. What jury would you have to convince that agreeing to less money than others is a good thing? How can the conference possibly be looking out for the members best interest?

Seems way easier to me and it forces a different argument. Our lawsuit pretty much looks the exact same as FSU’s. The ACC was ready for it.

Right now we're just trying to get the court's opinion on the GOR and exit fee. Are they iron clad?

to give the ACC the chance to do the right thing. Looks like the ACC has dug their heels in so it might be about to get nasty. I wouldn't be surprised to see us go after the Swofford sweetheart deal for his son and the cryptic agreements between the ACC and ESPN. Being forced to stay in the ACC will ultimately lead to us no longer being a legitimate contender in the CFP.

ACC should just admit that they were incompetent in securing a good deal with ESPN. ACC schools signed the deal but what choice did they have. Ol' Swofford was ecstatic with it, he built a very good nest egg for himself and his son.

The ACC has always reacted and has never been proactive. The ACC should release the FB schools (with a fair exit fee and maybe a little sumpin-sumpin for the GOR) and concentrate on being a BB only conference; it's what they really want.

The signing of the new CFP distribution model was asinine...the ACC basically admitted we really don't care much for FB.

school President at the time was THE driving force to bring ND into the fold under the scenario they currently are.

I get that Clemson sees it's in their/our best interests to try and get out now, but all this 'they did it to us!' fiasco on here is just not true. Clemson was a willing and sometimes leading proponent to the situation we are in today.

Your argument isn't really going to work for this reason. You're making the assumption that the ACC's market value is going to be the same as the SECs or the Big Ten's. If the ACC's free market value is lower than that of the SEC's or the Big Ten's, then you're not going to be able to show incompetence. You would only be able to show incompetence if you could prove that the ACC's free market value is the same as the value for those other two conferences.

The ACC never tried to get a TV deal with anyone but ESPN. THEY could have tried FOX, CBS, NBC, streaming services, etc. Instead, they got in bed with ESPN who had a deal with SEC and were never going to pay the ACC as much since they got a sweetheart deal with Swofford. ESPN locked up the ACC media rights for a pittance to keep the media rights to the ACC from going elsewhere. Swofford sold us out to benefit his son and Raycom.

And when discovery gets underway, it will be revealed and the ACC knows it and will settle. Right now, they are bluffing. Did schools know when they signed the GOR deal, that the contract was not guaranteed by ESPN beyond 2026? Or did it just become known after FSU filed suit?
